COMBINED SYNOPSIS/SOLICITATION This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. (A) The solicitation number is 70Z04220QPCV54000 and is issued as a Request for Quote (RFQ). The USCG intends to award a Firm-Fixed Price (FFP) Purchase Order using Simplified Acquisition Procedures (FAR 13) resulting from this solicitation to the responsible vendor whose proposal conforms to this solicitation and is determined to be most advantageous to the Government. (B) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular Number/Effective Date: 2020-06 / 05-06-2020 (C) This acquisition is set-aside 100% for small business concerns only. The associated NAICS code is 811310 and the small business size standard is $8.0 million. (D) Description/Location of Work - Contractor shall provide all equipment, labor, services & supervision necessary to complete Crane Repair services at U.S. Coast Guard Base, Building #6, Elizabeth City, North Carolina. See the attached USCG Scope of Work for the services required. Travel and/or Transportation of Equipment/Materials: If applicable, all costs associated are included within the contractor's proposal. (E) Additional Information: FIELD OFFICE Office space and telephone service required for the Contractor’s operations shall be the responsibility of the Contractor. WORK OUTSIDE REGULAR WORK HOURS If the contractor desires to perform work under this contract outside regular work hours or on Saturdays, Sundays or holidays, a written request shall be made, to the Contracting Officer and Quality Assurance Evaluator (QAE) and/or Contracting Officers Representative (COR) no less than 5 calendar days prior to the planned start of such work. Regular work hours are, for the purpose of this clause, those hours the activity or Command, where the work is to be performed, normally works on a day-by-day basis. Application by the Contractor does not imply consent by the Government. Each application will be considered, and a decision made, on the potential benefit of permitting such work. Approval of a Contractor’s application under this clause will be, unless otherwise agreed in writing, at no additional cost to the Government. ENVIRONMENTAL IMPACT All waste materials generated by any work under the contract performed on a Government installation shall be handled, transported, stored, and disposed of by the Contractor and by his Subcontractors at any time in accordance with all applicable Federal, State, or local laws, ordinances, regulations, court orders, or other types of rules or rulings having the effect of law, including but not limited to Executive Order 11752, 17 Dec 73, the Federal Water Pollution Control Act, as amended (33 USC Sec 1251 ET SEQ); The Clean Air Act, as amended (42 USC SEC 1857 ET SEQ); The Endangered Species Act, as amended (16 U.S.C. SEC 1531 ET SEC); The Toxic Substances Control Act, as amended (15 U.S.C. SEC 2601 ET SEC); The National Historic Preservation Act, as amended (16 U.S.C. SEC 470, ET SEQ); the Solid Waste Disposal Act as amended (424 SEC 6901 ET SEQ); and the Archaeological and Historic Preservation Act, as amended (16 U.S.C. SEC 469, ET SEQ). DAMAGE TO UTILITIES In the event of a Contractor-caused utility failure/disruption, the Contractor will first make the area safe, then immediately contact the QAE/COR. If the damaged utilities are previously known or shown to the Contractor, or there is negligence on his part, the utilities will be repaired by the Contractor in a timely manner at no cost to the Government. If the damaged utilities are not known or shown to the Contractor and there is not negligence on the contractor’s part, they will be repaired at Government expense. EQUIPMENT Equipment to be used on base shall be safe and in good operating condition. The Contracting Officer and designated QAE/COR reserve the right to inspect any on base equipment and reject such equipment if it is considered unsafe, in poor operating condition, or inappropriate for work. (F) Acceptance Plan - Completion of work under this contract will be monitored and accepted by a designated QAE/COR. (G) FAR Provision 52.212-1, Instructions to Offerors - Commercial, is incorporated by reference and applies to this acquisition. Addendum to FAR Provision 52.212-1 - the following paragraphs are modified or added to the provision: (b) Submission of Offers. - Modified Submit signed and dated offers to the Contracting Officer specified in this solicitation on or before the exact date and time specified in this solicitation. Submit a detailed quote/proposal to include an itemized cost breakdown with offer. Products, Services, Shipping, Delivery, and/or incidental charges shall be included on the quote as separate line items. All responsible sources may submit an offer which shall be considered by the agency. Offerors are encouraged to use their standard form for quoting purposes. Offers may be submitted on company letterhead stationery and must include the following information: (1) The solicitation number; (2) The time specified in the solicitation for receipt of offers; (3) The name, address, telephone number, and e-mail address of the offeror; (4) Business Size (in accordance with Federal Government Standards): Small ___ Large ___ Women-Owned __Disadvantaged __Veteran-Owned___ Service-Disable Veteran-Owned ___; (5) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. (c) Period for Acceptance of Offers. - Modified The offeror agrees to hold prices in its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is specified in an amendment to the solicitation. (k) Registration in System for Award Management (SAM) is MANDATORY. The offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and the required annual updates to keep an active registration at https://www.sam.gov (H) Evaluation of Offers shall be performed iaw FAR 13.106. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Lowest Priced, Technically Acceptable. The Government will evaluate offers in response to this solicitation with or without discussions; Offers that are unrealistic in terms of price will be deemed reflective of an inherent lack of technical competence or indicative of a failure to comprehend the complexity and risk of the proposed contract. Such offers may be rejected as unacceptable without further discussion; The Government may reject any or all offers and waive informalities or minor irregularities in offers received; The Government may accept any item or combination of items, unless doing so is precluded by a restrictive limitation in the solicitation. All questions must be received in this office not later than 3 working days prior to the closing date stated for this RFQ solicitation (P) SECURITY AND CONTRACTOR PERSONNEL: USCG access-entry protocol requirements: In compliance with Homeland Security Presidential Directive 12 (HSPD12) Coast Guard has a standardized entry protocol for all personnel, vendors, suppliers, contractors, and subcontractors who require access to the military unit. Contractor personnel shall have photo identification at all times while visiting or working on Coast Guard facilities. Contractor, subcontractor, and delivery personnel are required to present appropriate photo identification to gain access to a Coast Guard installation. All vehicle access to government property requires a valid state driver’s license, vehicle registration and proof of liability insurance; otherwise access to the Coast Guard facility may be denied. All contract and subcontract personnel are subject to a background check conducted by USCG. All contractors are instructed to contact USCG QAE/COR for detailed requirements. EMPLOYEE IDENTIFICATION. Contractor personnel shall carry proper identification (ID) when on USCG Government property. Contractor employees visiting or working on any Government facilities shall wear an identification badge that, at minimum, displays the Contractor name, the employee’s photo, and badge expiration date. Proper ID is defined as either the individual driver's license, or a company issued ID. The identification must be laminated, and show a facial picture of the individual. Individuals without proper ID will be escorted off the Coast Guard premises. Contractor employees shall comply with all Government escort rules and requirements. All Contractor employees shall identify themselves as Contractors when their status is not readily apparent and display their identification badge in plain view above the waist at all times. QUALIFIED PERSONNEL. The contractor shall provide qualified personnel to perform all requirements and comply with all schedules specified under this contract. Selection and placement of individuals shall be based upon mutual agreement of parties and other screening measures as deemed appropriate by the contractor. Removal of the qualified personnel shall also be based on mutual agreement of the parties except for cases identified herein. WORKING SUPERVISOR. The Contractor shall provide a working supervisor, named in writing, who shall be responsible for the performance of all work. The working supervisor shall have full authority to act for the contractor. The Contractor shall provide to the Contracting Officer, in writing, within 10 calendar days after award the name, address, and telephone number of the working supervisor. In the event the working supervisor is replaced; the Contractor shall furnish the above information before the new replacement commences work under this contract. CONSUMPTION OF ALCOHOL AND DRUGS. Contractor personnel, while on Coast Guard Training Center Cape May property, are subject to standards of conduct prescribed for Government employees. The use of alcohol, drugs, or harmful substances will result in barring of individual from Government facilities and of all government property. All employees working under this contract shall be the citizens of the United States of America, or aliens who have been lawfully admitted for permanent residence, as evidenced by Alien Registration Receipt Card, Form 1-151. Acceptable evidence shall consist of a birth certificate or naturalization papers issued by Federal Courts. EMPLOYEE CONDUCT. Contractor’s employees shall comply with all applicable Government and Agency regulations, policies and procedures (e.g., fire, safety, sanitation, environmental protection, security, “off limits” areas, and possession of weapons) when visiting or working at Government facilities. The Contractor shall ensure contractor employees present a professional appearance at all times and that their conduct shall not reflect discredit on the United States, the Department of Homeland Security or the U.S. Coast Guard. REMOVING EMPLOYEES FOR MISCONDUCT OR SECURITY REASONS. The Government may, at its sole discretion, direct the Contractor to remove any Contractor employee from U.S. Coast Guard facilities for misconduct or security reasons. Removal does not relieve the Contractor of the responsibility to continue providing the services required under any contract. The Contracting Officer will provide the Contractor with a written explanation to support any request to remove an employee. CONFLICT OF INTEREST. The Contractor shall not employ any person who is an employee of the United States Government if that employment would, or would appear to cause a conflict of interest. The Contractor shall not employ any person who is an employee of the Government. (Q) Post-award, the Contractor shall provide the designated USCG COR with a list of the names of all personnel who will be working on the site. The Contractor may submit a revised list at any time during the project. Only personnel on the approved listing will be allowed on the site. (R) Post-award, Invoice Submission Procedures: To be provided with government purchase order. (S) Notice For Filing Agency Protests - United States Coast Guard Ombudsman Program: It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO). Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman. Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable). Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e).
