Pursuant to Federal Acquisition Regulation (FAR) 12.603(c)(2): (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) The solicitation number is 70T05020R9DMED049. The solicitation is issued as a request for proposal (RFP). (iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020-07. (iv) This acquisition is set-aside for small business concerns. The associated NAICS code is 331318 with a small business size standard of 750 employees. (v) A list of line item numbers and items, quantities, and units of measure: See attachment 2 “Schedule” NOTE (1): The TDC Shielding shall be delivered fully assembled. All other products identified as “configurations” in the schedule will be assembled on-site by Government personnel. NOTE (2): The first ordering period will commence on the day of contract award and continue for one year after award. Subsequent periods will also be for one year each. Actual dates for the ordering periods will be stated in the contract at time of award. NOTE (3): Indefinite Delivery, Indefinite Quantity (IDIQ) Contract (Minimum and Maximum Amount) – During the period of performance of this contract, the Government may issue one or more orders. The minimum guarantee for the IDIQ is $10,000 per IDIQ contract awarded. The minimum guarantee will be obligated via separate delivery order(s) issued simultaneously with contract award(s). The maximum contract value for all order(s) against all IDIQ contract award(s) shall not exceed $40,000,000. (vi) Description of requirements for the items to be acquired – The contractor shall provide the Transportation Security Administration (TSA) with supplies necessary to mitigate the transmission of infectious agents (e.g. viruses, bacteria, etc.) including, but not limited to, the novel coronavirus disease (COVID-19). The solicited requirement includes physical barriers (e.g. protective panels and posts); however, any modifications to products in the schedule, or the inclusion of any additional product that is determined necessary to mitigate the transmission of an infectious agent is in the scope of the contract and may be added to the contract via modification with concurrence of the contractor(s). (vii) Dates and places of delivery will be stated in individual call orders. Acceptance is at, and FOB point is Destination for all goods shipped to locations in the Continental United States (CONUS). Acceptance is at, and FOB point is Origin for all goods shipped to locations Outside the Continental United States (OCONUS). For the purposes of this acquisition, CONUS locations are the 48 conterminous states and the District of Columbia. OCONUS locations are all other states, commonwealths, districts, territories, and possessions, etc. of the United States. No shipment to an international location will be required under this contract. (viii) The provision at 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. The following addenda apply: Paragraph (b)(4) is replaced with the following text: “A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This shall include renderings of all proposed “Configurations” in the schedule. Examples of anticipated renderings are pictures of fully assembled as-built configurations or artistic representations of as-designed configurations. The description may include any other product literature or other documents necessary to evaluate compliance;” Paragraph (j) is modified by adding the following text after the last sentence: “For the purposes of this acquisition, the ‘Unique Entity Identifier’ is synonymous with the Dun and Bradstreet (DUNS ®) number, which shall be provided as described herein.” Note: Consistent with FAR 12.603(b), this solicitation is not issued on a Standard Form 1449. As such, offerers are advised to include the very specific elements that are required per paragraph (b) of the provision for offers not submitted on a Standard Form 1449. (ix) The provision at 52.212-2, Evaluation-Commercial Items does not apply to this acquisition. This competitive acquisition will be conducted in accordance with FAR 15. A best value “Price Performance Tradeoff” process, following a determination of technical acceptability, will be performed between the factors of Price and Past Performance. Competing Offerors' past performance history will be evaluated on a basis approximately equal to cost or price considerations. Eligibility for award will be contingent upon the contracting officer’s affirmative determination of responsibility. Any clarifications conducted to resolve minor or clerical errors or respond to adverse past performance information will not constitute discussions. The evaluation process will proceed as follows: Step 1: The Government will review offers to determine compliance. Offers may be determined to be non-compliant if they omit or do not reasonably address the requirements of the solicitation. Offers determined to be non-compliant will not be further evaluated. Offers from Offerors that are not registered in the System for Award Management for “All Awards” with completed representations and certifications at the time the offers are due will be non-compliant. Step 2: The Government will evaluate offers remaining from Step 1 to ensure offer compliance with the stated technical acceptability requirements. Technical acceptability is pass/fail. Step 3: The Government will evaluate price for all offers remaining from Step 2. The evaluation will consist of an evaluation of reasonableness, balance, and total evaluated price. Step 4: The Government will rank the offers remaining after Step 3 in order of lowest to highest total price. Step 5: The Government will evaluate the past performance. In order to promote an efficient evaluation process, the Government may limit the evaluation of past performance to the seven lowest priced Offerors if more than seven offers remain at this stage. Step 6: The Government will then conduct its Price Performance Tradeoff. All offers evaluated under Step 5 will be forwarded to the Source Selection Authority (SSA). Step 7: The SSA will make a best value award decision most advantageous to the Government. The SSA will determine the total number of and to which Offerors awards to be made. (x) Offerors are advised to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items with its quote. NOTE: If annual representations and certifications have been completed in www.sam.gov, the Offeror must still complete paragraph (b) of provision and submit with its proposal. (d) Comptroller General Examination of Record. As used in this clause— “Covered article” means any hardware, software, or service that– (1) Is developed or provided by a covered entity; (2) Includes any hardware, software, or service developed or provided in whole or in part by a covered entity; or (3) Contains components using any hardware or software developed in whole or in part by a covered entity. “Covered entity” means– (1) Kaspersky Lab; (2) Any successor entity to Kaspersky Lab; (3) Any entity that controls, is controlled by, or is under common control with Kaspersky Lab; or (4) Any entity of which Kaspersky Lab has a majority ownership. (b) Prohibition. Section 1634 of Division A of the National Defense Authorization Act for Fiscal Year 2018 (Pub. L. 115-91) prohibits Government use of any covered article. The Contractor is prohibited from— (1) Providing any covered article that the Government will use on or after October 1, 2018; and (2) Using any covered article on or after October 1, 2018, in the development of data or deliverables first produced in the performance of the contract. (c) Reporting requirement. (1) In the event the Contractor identifies a covered article provided to the Government during contract performance, or the Contractor is notified of such by a subcontractor at any tier or any other source, the Contractor shall report, in writing via email, to the Contracting Officer, Contracting Officer’s Representative, and the Enterprise Security Operations Center (SOC) at NDAA_Incidents@hq.dhs.gov, with required information contained in the body of the email. In the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Enterprise SOC, Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) and Contracting Officer’s Representative(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil. (2) The Contractor shall report the following information pursuant to paragraph (c)(1) of this clause: (i) Within 1 business day from the date of such identification or notification: the contract number; the order number(s), if applicable; supplier name; brand; model number (Original Equipment Manufacturer (OEM) number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended. (ii) Within 10 business days of submitting the report pursuant to paragraph (c)(1) of this clause: any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of a covered article, any reasons that led to the use or submission of the covered article, and any additional efforts that will be incorporated to prevent future use or submission of covered articles. (d) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts, including subcontracts for the acquisition of commercial items. (End of clause) ? 52.204-25 PROHIBITION ON CONTRACTING FOR CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (DEVIATION 2020-05) (a) Definitions. As used in this clause— “Covered foreign country” means The People’s Republic of China. “Covered telecommunications equipment or services” means– (1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities); (2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities); (3) Telecommunications or video surveillance services provided by such entities or using such equipment; or (4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country. “Critical technology” means– (1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations; (2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled- (i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or (ii) For reasons relating to regional stability or surreptitious listening; (3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities); (4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material); (5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or (6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817). “Sub...
