CLM GPS RAILCAR TRACKING REPORTING SUPPORT SERVICES (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) Solicitation number 70T05019R9NSTR006 is issued as a Request for Proposal (RFP). (iii) The solicitation document and all provisions and clauses are those in effect through Federal Acquisition Circular 2019-03, effective July 12th, 2019. (iv) This procurement is 100% set-aside for small business. The North American Industry System (NAICS) code is 518210 (Data Processing, Hosting, and Related Services), and the business size standard is $32.5M. (v) The Transportation Security Administration (TSA), Mission Essentials Acquisition Division (MEAD) intends to contract using other than full and open competition for Toxic Inhalation Hazard Rail Security Sensitive Material (TIHRSSM) Railcar Car Location Message and Global Positioning Satellite (CLM GPS) reporting support services (see attached requirements). Accordingly, the TSA intends to award a contract to Northeast Logistics Systems, LLC (NELS), 2 Central Street, Suite 107, Framingham, MA 01701. This contract will address the requirements of TSA's Office of Surface Compliance (SO) and the Policy, Programs & Engagement (PPE) Office. The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Interested vendors who may wish to seek subcontracting opportunities should contact the above named company directly. (viii) Conditions for Evaluation: The quote will be evaluated to determine if it's technically acceptable. "Technically acceptable" means the quote meets all the SOW requirements. Award will be made to the responsible offeror whose quotation conforms to the solicitation requirements, provides an acceptable overall technical approach, and offers the lowest price, and favorable past performance. This acquisition will utilize the Lowest Priced Technically Acceptable (LPTA) evaluation approach. A decision on the technical acceptability of each offeror's quotations will be made. For those offerors determined to be technically acceptable, award will be made to that vendor with the lowest overall price and acceptable past performance. The Government may, at its discretion, decide to first identify the low price offeror, and then determine if its proposal offers an acceptable past performance and technical approach. If so, award will be made to that offeror. If not, the agency moves to the next lowest priced proposal to determine if it is technically acceptable with acceptable past performance, and so on until award is made. The Government intends to make an award based on the initial quotations. If further questions are required, the contracting officer may contact the offeror or offerors. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
