Additionally, as stated in the initial Questions and Answers, TSA will not be including an Economic Price Adjustment (EPA) clause in this solicitation or the resultant contract. An offeror that proposes an additional term such as an EPA runs the risk that their offer would be found to be nonconforming and/or unacceptable. In the RFP, TSA states that: “To the extent an offeror takes exception to a Government term or proposes additional or alternate terms, that offeror runs the risk that the Government finds such an offer nonconforming and/or unacceptable. Nonconforming offers will be evaluated as posing additional risk to the Government.
