INTENT TO SOLE SOURCE This is a notice of intent to Sole Source synopsis as required under FAR 5.2. This procurement is being conducted using commercial item procedures pursuant to FAR Part 12 and FAR Part 13, specifically FAR Subpart13.106-1(b)(1)(i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available, allowing the Contracting Officer (CO) to solicit from one source. This Notice of Intent (NOI) is to inform industry contractors of the Government's intent to execute a Sole Source Award under FAR Part 13 - Simplified Acquisition Procedures (SAP), specifically FAR Subpart 13.5 - Simplified Procedures for Certain Commercial Items in accordance with 41 USC 1901. The Department of Homeland Security, Customs and Border Protection, 1331Pennsylvania Avenue, NW, Washington, DC 20229, intends to negotiate and award a sole source procurement to Aware, Inc., 40 Middlesex Tpke, Bedford, MS 01730-1404. The procurement will be to provide 1,000 Aware CaptureSuite TM Software, Version 5.14 licenses and maintenance. This procurement will also provide the maintenance for 3,905 current licenses for a total of 4,905 (1000, new license maintenance and 3,905 current license maintenance) in maintenance. This contract is expected to be for a one year base period (1,000 license and 4,905 maintenance) and four (4) one year option periods (4,905 maintenance only). The Government believes that only one source can satisfy the agency's requirement because although there are other small business companies capable of providing 10-print solutions/maintenance, Aware Inc. possesses unique customized capabilities to meet CBP's requirement. The amount of time and funding that it would take to re-develop, integrate, test & deploy a new interface to our CBP applications, along with the impact of having to transition-in (acquire Background Investigation (BI) clearances) and train a new provider would be too significant at this time. Such capabilities information will be used solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. All information shall be furnished at no cost or obligation to the Government. A determination by the Government not to open the requirement to competition based upon responses to this notice is solely within the discretion of the Government.
