This contract action is for the acquisition of supplies for which the Government intends to solicit and negotiate with only one source under the authority of Federal Acquisition Regulation (FAR) Subpart 13.106-1(b)(1). The National Institute of Environmental Health Science (NIEHS), Office of Acquisitions (OA) intends to award a single source purchase order to ProteinSimple, 3001 Orchard Parkway, San Jose, CA 95134. The proposed contract action is for a Jess Platinum Service Plan. The Jess Simple Western System is used for analyzing experimental samples produced in the lab. This platinum service plan is of critical importance for consistent, accurate and uninterrupted performance of the equipment. The Jess Platinum Service Plan provides unlimited on-site service and includes one preventive maintenance visit for the Jess System. This plan includes all parts, labor and travel. ProteinSimple is the manufacturer and sole distributor of this equipment. They do not allow third party entities to service their equipment. The applicable North American industry Classification System (NAICS) code for this procurement is 811219 “Other Electronic and Precision Equipment Repair and Maintenance.” Its associated Business Size Standard is $22.0. (This requirement is for the Base + 2 Option Years) Base Period: March 26, 2022-March 25, March 25, 2023 Option Period 1: March 26, 2023-March 25, 2024 Option Period 2: March 26, 2024-March 25, 2025 NIEHS will solicit and negotiate directly with ProteinSimple, and no solicitation will be issued. This notice of intent is not a request for competitive proposals or quotations; however, all responsible sources may submit a capability statement which shall be considered by the agency. Offerors must have an active registration in the System for Award Management (SAM.GOV) www.sam.gov. A determination by the Government not to compete this proposed requirement based on responses to this notice is solely within the discretion of the Government. Interested parties must express their interest and must be submitted in writing via email to Valarie K. Sims at sims3@niehs.nih.gov and are due by 10:00 AM, January 6, 2022. No faxed documents will be accepted. If no responsive statements are received by the due date, an award will be made to SimpleProtein.
