(NOI). This notice is published in accordance with Federal Acquisition Regulation (FAR) 5.101(a)(1) requiring the dissemination of information regarding proposed contract actions. This is a Notice of Intent to award a Sole Source Firm-Fixed Price Contract under the authority of 41 U.S.C. 3304(a)(1), as implemented by FAR 13.106-1(b) – Only One Responsible Source and No Other Supplies or Service Will Satisfy Agency Requirements and is not a request for competitive quotes. The National Institute of Allergy and Infectious Diseases (NIAID) Rocky Mountain Laboratories (RML) intends to award a firm-fixed price sole source contract to: FEI Company 5350 NE Dawson Creek Dr Hillsboro, OR for: Annual service agreement on the Titan Krios TEM, including the HT Generator, FEG Unit, STEM Package, Phase plate, Falcon 3EC Detector The associated North American Industry Classification System (NAICS) code for this procurement is 811219 with a small business size standard of $22.0M. FEI Company is other than a small business. This will be the only notice of the Government’s intent to solicit, negotiate, and award to one source to satisfy this requirement. The Government plans to award a contract for this requirement within 30 days of this notice. While this synopsis does not constitute a solicitation, interested vendors may identify their interest and capability to satisfy this requirement. The Government understands that FEI Company is the only vendor which can provide the requested services for NIAID. However, firms that believe they can provide the capability required to fully meet the Government's requirement may submit a capability statement, proposal or quotation that will be considered by this Agency in writing to the identified point of contact within the ten (10) day posting period of this notice. Such documentation shall be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. Interested parties may identify their interest and capability to respond to the requirement or submit offers on NOI-RML-C-2010030. All responsible sources who are certified by FEI Company as an authorized third-party service/repair vendors may submit a proposal showing their capabilities and past performance repairing this type of equipment. The vendors shall provide certification from the original equipment manufacturer (FEI Company) that they are authorized to perform these services and have access to OEM parts and supplies. All responsible sources may submit a response that will be considered. Award will be based on the capability of the service/item offered to meet the above stated salient characteristics, past performance, delivery, warranty, price and the best value to the government.
