This notice is published in accordance with Federal Acquisition Regulation (FAR) 5.101(a)(1) requiring dissemination of information regarding proposed contract actions. This is a Notice of Intent to award a Sole Source Firm Fixed Price Contract under the authority of 41 U.S.C. 3304(a)(1), as implemented by FAR 13.106-1(b) – Only One Responsible Source and No Other Supplies or Service Will Satisfy Agency Requirements and is not a request for competitive quotes. The National Institute of Allergy and Infectious Diseases (NIAID), Rocky Mountain Laboratories (RML), intends to negotiate on a sole source basis with BECTON, DICKENSON AND COMPANY, 2350 QUME DR, SAN JOSE, CA, 95131-1812, UNITED STATES for the procurement of a four service contracts. The following services are being procured… 1. Svc Cont FACSAria II Special (NO LASERS) 643925 1 EA Coverage includes the BD FACSAria II Special Order System with one Computer Workstation (excluding printers) for labor, travel expenses and parts (excluding consumables), for the following: - 2 Preventive Maintenance Inspections to be performed during a twelve-month period, including 2 PM Kits. - Software Revisions released during the Agreement term. - Unlimited service visits, Monday-Friday, excluding BD Biosciences holidays. - Unlimited telephone support for instruments, reagents and applications will be provided at no additional charge. - Every reasonable effort will be made to respond to a request for emergency on-site service (Monday through Friday, excluding BD Biosciences holidays) within 48 hours. 200 Svc Cont SAPPHIRE 488-100 Blue Lsr 640100 1 EA 300 Svc Cont CUBE 635-25C Red Lsr 642080 1 EA 400 Svc Cont Laser CUBE 405-50C Violet 642079 1 EA *Kits and services can ONLY be provided by BD Bioscience (a.k.a. OTHER ELECTRONIC AND PRECISION EQUIPMENT REPAIR AND MAINTENANCE with a small business size standard of $22.0M. BD Bioscience is not a small business. This will be the only notice of the Government’s intent to solicit, negotiated, and award to one source to satisfy this requirement. The Government plans to award a contract for this requirement within 10 days of this notice. While this synopsis does not constitute a solicitation, interested vendors may identify their interest and capability to satisfy this requirement. The Government understands that Becton, Dickenson and Company is the only vendor which can provide the requested products for NIAID. However, firms that believe they can provide the capability required to fully meet the Government's requirement may submit a capabilities statement, including past performance, in writing to the identified point of contact within fifteen (10) days after publication of this notice. Such documentation shall be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.
