This is a Notice of Intent, not a request for proposal. The National Institute of Allergy and Infectious Diseases (NIAID) of the National Institutes of Health (NIH) intends to negotiate on an other than full and open competition basis with BD BIOSCIENCES, Inc for a maintenance service agreement in support of the following equipment: BD LSRII serial # H1171. The service agreement will include 2 preventative maintenance visits to include labor, parts and kits, software support, service visits, telephone coverage and guaranteed 48-hour emergency response time. This follow on maintenance includes on-site service for critical equipment, the BD LSRII system listed above. This equipment is routinely utilized for the analysis of clinical and experimental samples in the support of the Laboratory of Systems Biology (LSB) part of the Division of Intramural Research. BD Biosciences is the sole source provider as they are the manufacturer of this equipment and the LSB requires certified technicians, OEM parts and guaranteed response times. Place of delivery is NIH Campus, 9000 Rockville Pike, Bethesda, MD 20892. The statutory authority for this sole source requirement is 41 U.S.C. 253 (c) (1) as implemented by FAR 13.106-1 only one responsible source and no other supply of service will satisfy agency requirements. THIS IS NOT A REQUEST FOR PROPOSAL. All responsible sources that could provide comparable services may submit a capability statement that will be considered by email (subject line to reference NOI-RML-2033657) to Bevin Feutrier at bevin.feutrier@nih.gov, August 26.2020 . All responses received by the closing date of this synopsis will be considered by the Government. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.
