(NOI). This notice is published in accordance with Federal Acquisition Regulation (FAR) 5.101(a)(1) requiring the dissemination of information regarding proposed contract actions. This is a Notice of Intent to award a Sole Source Firm-Fixed Price Contract under the authority of 41 U.S.C. 3304(a)(1), as implemented by FAR 13.106-1(b) – Only One Responsible Source and No Other Supplies or Service Will Satisfy Agency Requirements, and is not a request for competitive quotes. The National Institute of Allergy and Infectious Diseases (NIAID) intends to award a firm-fixed price sole source contract to Lab Products 742 Sussex Ave, Seaford DE 19973 for the procurement of: Replacement animal caging components and consumables to be used within the Laboratory of Animal Science Section at NIH. Lab Products is the manufacturer of the current approved caging system, specifically designed by Lab Products. Lab Products is the only company that can produce and provide the caging components and consumables to fit their caging. The current cages designed by Lab Products are the approved cage and all components and consumables must be 100% compatible to ensure the animals cannot escape. These are the only components and consumables that will fit the current caging in the Animal Unit Facilities. Changing animal caging and consumables would be detrimental to the on-going studies and cause a great financial loss to the Federal Government. No substitutions are acceptable for the protection of the staff and the animals. The associated North American Industry Classification System (NAICS) code for this procurement is 332999 with a small business size standard of 750. Lab Products is a large business. This will be the only notice of the Government’s intent to solicit, negotiate, and award to one source to satisfy this requirement. The Government plans to award a contract for this requirement within 30 days of this notice. The statutory authority for this sole source requirement is 41 U.S.C. 1901 (a) (1) as implemented by FAR 13.106-1 only one responsible source and no other supply of service will satisfy agency requirements. THIS IS NOT A REQUEST FOR PROPOSAL. All responsible sources that could provide comparable services may submit a capability statement that will be considered by email (subject line to reference NOI-NIAID-2148027) to Diana Rohlman at diana.rohlman@nih.gov, by 4:00 pm eastern standard time, November 13, 2022. All responses received by the closing date of this synopsis will be considered by the Government. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.
