PRE-SOLICITATION NOTICE ADDENDUM TO NOI-NIAID-2112046 NAICS – 811219 This is a Notice of Intent, not a request for proposal. The National Institute of Allergy and Infectious Diseases (NIAID) of the National Institutes of Health (NIH) intends to negotiate on an other than full and open competition basis with Leica Microsystems Inc to procure annual maintenance service on multiple Aperio-branded Leica instruments/equipment used by the NIAID Comparative Medicine Branch (CMB), equipment deemed essential to perform immunohistochemistry and other routine sample collection and testing. See attached Addendum Document for equipment list. The purpose of this project is to secure repair and preventative maintenance against any future malfunctions on the Aperio-branded Leica instruments/equipment used by CMB. Aperio-branded, Leica Biosystems Imaging, Inc equipment is a division of Leica Microsystems Inc, the manufacturer of the instruments. The manufacturer only supports the use of its proprietary supplies and services for its machines. All warranties could be null and void if other than Leica completed work or service is attempted on these machines. Leica Microsystems Inc and its Exclusive Regional Dealers (ERD) are the only source for certified, factory trained service professionals on Leica Biosystems Division (BSD) equipment. Only Leica and its ERD's have access to the latest service and support information. The statutory authority for this sole source requirement is 41 U.S.C. 1901 (a) (1) as implemented by FAR 13.106-1 only one responsible source and no other supply or service will satisfy agency requirements. THIS IS NOT A REQUEST FOR PROPOSAL. All responsible sources that could provide comparable services may submit a capability statement that will be considered by email (subject line to reference NOI-NIAID-2112046 to Dana Monroe at dana.monroe@nih.gov, by 5:00pm PDST February 9, 2022. All responses received by the closing date of this synopsis will be considered by the Government. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.
