The National Institutes of Health (NIH), National Institute of Environmental Health Sciences (NIEHS) hereby issues this notice of intent in accordance with (IAW) FAR 5.201. NIEHS intends to negotiate a sole-source, firm-fixed price (FFP) purchase order pursuant to FAR 13.106(b): Only One Responsible Source and No Other Supplies or Services Satisfy Agency Requirements, to Mathworks, Inc. (“Mathworks”), 3 Apple Hill Dr., Natick, MA 01760-2098. The resulting procurement of this purchase order will be conducted in accordance with Part 13.5 – Simplified Procedures for Certain Commercial Items and FAR Part 12 – Acquisition of Commercial Items. The NIEHS requires annual software maintenance services for MATLAB and Simulink Institute-Wide Software Suite. See the attached Sole Source Justification for additional details. The following classification codes are applicable to this requirement: * North American Industrial Classification System (NAICS) Code: 511210 – Software Publishers; business size standard: $41,500,000. * Product and Service Code (PSC): 7A21– IT and Telecom – Business Application Software. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE QUOTES OR PROPOSALS. However, IAW FAR 5.207(c)16(ii), all responsible sources may submit a capability statement which may be considered by the agency. A determination not to compete this requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred in connection with responding to this notice.
