This has been corrected to reflect the actual closing date of January 14, 2020. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6 "Streamlined Procedures for Evaluation and Solicitation for Commercial Items", as supplemented with additional information included on this notice. This announcement constitutes the only solicitation; offers are being requested, and a written solicitation document will not be issued. The solicitation number is NIH-CC-DTM-10302019-RTB and is issued as a Request for Proposal (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2019-06. This acquisition will be made pursuant to the authority of FAR 13.5 to use simplified acquisition procedures for commercial requirements. This procurement is NOT a total small business set aside. The Government intends to issue a Firm Fixed Priced type contract for a base year and four (4) twelve month option periods. The associated North American Industry Classification System (NAICS) Code is 621991 with a business standard size of $32.5 million. {Amendment 1} Contract line items to be provided are: Red Blood cells (Est Annual Qty 500), Activated Protein C and Antigen Matched Units (Est Annual Qty 600), Cryogenic Storage Estimated Annual Qty 400) DESCRIPTION OF REQUIREMENT: The NIH Department of Transfusion Medicine (DTM) in Bethesda, Maryland, intends to award contract to for the provision of blood products related to transfusion services in the Clinical Center, a 200-bed hospital serving patients coming to the NIH under research protocols. The work is required by the Transfusion Services Laboratory (TSL) to meet transfusion needs for specific patients under research protocol requiring transfusion therapy for red blood cells (RBC) and plasma blood products. The award is anticipated to be made on or around January 1, 2020. The place of delivery and performance is: National Institutes of Health Department of Transfusion Medicine 9000 Rockville Pike-CRC Bethesda, MS 20892 Evaluation Applicable evaluation procedures is described within the Attachment 3, titled EVALUATION CRITERIA. The Trade-Off selection procedures will be used to make a best value award decision. An award will result in one Indefinite Delivery/Indefinite Quantity (IDIQ) contract. Annual Task Orders (TOs) will be issued against the IDIQ contract. The Government intends to award a basic contract to the offeror deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose proposal conforms to the RFP requirements and judged to represent the Best Value to the Government. Best Value is defined as those most advantageous offers, price and non-price factors considered. PROVISIONS Provisions/clauses may be obtained via www.arnet.gov. The provision at 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition with the following ADDENDA: OFFER PREPARATION INSTRUCTIONS: ADDENDA 1). The offeror shall submit a proposal on letterhead stationary providing the following: a. Evidence to meet the required statement of work, with past performance and reference criteria (10-25) pages maximum. Interested parties who meet the requirements as outlined in the SOW are invited to submit a proposal, including statements of how the proposal will meet the Government requirements found in the Evaluation Criteria. All information furnished shall be legible, typed and must contain sufficient detail to allow the government to evaluate and determine best value. b. Pricing must be submitted separately from technical responses. Offerors are encouraged to submit their most advantageous pricing arrangements in a document labeled-"Price Proposal". The proposal shall include pricing for the base year, and each subsequent (4) four option year periods. All option periods shall be priced separately and clearly identified. The price per unit can be defined as a fixed dollar amount or as a price range if exact costs of unit or subcomponents of unit cannot be fixed. The price proposal must include pricing for: Red Blood cells (Est Annual Qty 500); Activated Protein C and Antigen Matched Units (Est Annual Qty 600); Cryogenic Storage (Estimated Annual Qty 400); and any subcomponents thereof (Optional). The price proposal shall also address estimates for annual shipping and handling if this price element will be applied separately, transactional costs, and/or various miscellaneous cost. For this requirement the offeror is given wide latitude in the format for pricing however each required element in the aforementioned instructions shall be addressed. The solicitation does not commit the Government to pay any cost for the preparation and submission of a quote or proposal. It is also advised that the Contracting Officer (CO) is the only individual who can legally commit and obligate the Government to the expenditure of public funds in connection with the proposed acquisition. 2) SAM: Vendors must be registered in the System for Award Management (SAM) prior to the award of a contract. You will need the company Dun & Bradstreet number and banking information. 3) A subcontracting plan, Attachment 4, must be completed and submitted as a condition of award. ORDER LIMITATIONS (OCT 1995) (a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than 1 EACH, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The Contractor is not obligated to honor- (1) Any order for a single item in excess of the Estimated Ceiling; (2) Any order for a combination of items in the Estimated Ceiling; or (3) A series of orders from the same ordering office within 2 days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section. (c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section. Upon receiving this notice, the Government may acquire the supplies or services from another source. (End of clause) 52.216-22 -- Indefinite Quantity. Indefinite Quantity (OCT1995) (a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract. (b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum." (c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations. (d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after Contract Expiration. OPTION TO EXTEND SERVICES (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 5 days of the contract expiration date. (End of clause) 52.217-9 Option to Extend the Term of the Contract. OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within one day; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.
