The purpose of this synopsis is to announce the Government’s intent to negotiate a Firm Fixed Price sole source purchase order with Brain View, LLC for an EEG system that is compatible with an existing NIRx near infrared spectroscopy (NIRS) system. The Government intends to negotiate solely with Brain View, under the authority of FAR 13.106-1(b)(1) as no other known source of supply will satisfy agency requirements. The Brain View EEG is needed as a component of an integrated system used for ongoing, collaborative studies on pain. The proprietary nature of the NIRx system at the hub of these studies requires the needed EEG to be have software and hardware that is compatible with the NIRx system. Only the Brain View LLC EEG meets this technical compatibility requirement. Please refer to the attached Statement of Need. This notice of intent/synopsis is not a request for competitive quotations. However, if any interested party, especially a small business, believes it can meet the above requirement, it may submit a capability statement, proposal or quotation which shall be considered by the agency. The statement of capabilities and any other information furnished must be in writing and must contain material in sufficient detail to allow NCI to determine if that party can perform the requirement. Responses must be received by the contracting office’s email server by 12:00 PM Eastern Time, on March 10, 2021. All responses and questions must be in writing and sent to the Contracting Officer, Christine Biser, via email (ChristineBi@mail.nih.gov). A determination by the Government not to continue with this proposed contract based up on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely to determine whether to conduct a competitive procurement. No collect calls will be accepted. In order to receive an award, contractors must be registered in the System for Award Management (SAM) and have a valid, current Entity Record, including current Representations and Certifications. The response date for the notice of this requirement is in accordance with FAR 5.101(a)(1). The equipment is being procured in accordance with FAR Part 12 – Acquisition for Commercial Items and in accordance with the simplified acquisition procedures as authorized by FAR Part 13.106-1(b)(1), and is exempt from the requirements of FAR Part 6. The resultant award for this commercial item (FAR Part 12) will include all applicable FAR Provisions and Clauses in effect through Federal Acquisition Circular (FAC) 2020-04 January 25, 2019 and as required by the National Institutes of Health and the National Cancer Institute. This requirement will result in only one firm fixed price purchase order. It has been determined that there are no opportunities to acquire green products or services for this procurement. INVOICING Invoices shall be submitted electronically per the commercial item invoicing instructions in the award and payment will be issued via three-way match.
