THIS IS A NOTICE OF INTENT TO SOLE SOURCE AND NOT A REQUEST FOR QUOTATION. The National Institute of Environmental Health Sciences (NIEHS), located in Research Triangle Park, North Carolina, intends to negotiate on a sole source basis and award a contract to Rigaku Americas Corporation (9009 New Trails Drive, the Woodlands, TX 77381) for a service contract for the Rigaku X-ray equipment which includes coverage on the MicroMax007HF X-ray generator, two VarimaxHF mirrors, two AF11 goniometers, two Cobra cryo units by Oxford Cryo systems, a Pilatus200K detector, and the software and hardware required to operate these systems. It also includes labor on the Saturn944 CCD detector. The period of performance is from April 1, 2022 to March 31, 2023. This acquisition is being conducted using the procedures under Federal Acquisition Regulations (FAR) Subpart 13.5, “Simplified Procedures for Certain Commercial Items” in accordance with 41 U.S.C. 1901. The FAR as supplemented by the Health and Human Services Acquisition Regulation (HHSAR) will be used to evaluate the quote and award this requirement. The North American Industry Classification System (NAICS) code for this requirement is 423490 (Other Professional Equipment and Suppliers Merchant Wholesalers) with a size standard of 150. The NIEHS is one (1) of 27 research institutes and centers that comprise the National Institutes of Health (NIH), U.S. Department of Health and Human Services (DHHS). NIEHS will solicit and negotiate directly with Rigaku Americas Corporation and no solicitation will be issued. This notice of intent is not a request for competitive proposals or quotations; however, if an interested party believes they can meet the above requirement, all responsible sources may submit a capability statement which shall be considered by the agency. The statement must be submitted in writing and must contain material in sufficient detail to allow the Government to determine if the party can perform the requirement. Respondents must have an active registration in the System for Award Management (SAM) www.sam.gov. A determination by the Government not to compete this proposed requirement based on responses to this notice is solely within the discretion of the Government. All interested parties must express their interest in writing via email to ejinwaemeonu.okeagu@nih.gov by 12:00 pm Eastern time Monday, March 28, 2022. No faxed documents will be accepted. If no responsive statements are received within the stated time, an award will be made to Rigaku Americas Corporation.
