This is a Pre-solicitation Notice for a proposed contract action, not a request for quotations (RFQ). The National Institute of Allergy and Infectious Diseases (NIAID) of the National Institutes of Health (NIH) intends to negotiate on an other than full and open competition basis with TA INSTRUMENTS-WATERS LLC to procure one (1) AFFINITY ITC Low Volume – Gold Cells calorimeter. The Research Technologies Branch (RTB) of the Division of Intramural Research (DIR) offers investigators specialized support for advanced biotechnology research. RTB provides access to state-of-the-art research technology, scientific expertise, and technical support to enhance the research efforts of all NIAID intramural investigators. The RTB currently uses a Nano ITC from TA Instruments. An additional ITC is required to use with the current Nano ITC to increase RTB’s capability to better meet the demand from the DIR, to have the ability to use established and optimized protocols, and to ensure that samples run under either system remain consistent. TA INSTRUMENTS is the sole manufacturer of this calorimeter and the sole provider for the parts and maintenance for these instruments. The statutory authority for this sole source requirement is 41 U.S.C. 253(c)(1) as implemented by FAR 6. 302-1 only one responsible source and no other supply will satisfy agency requirements. THIS IS NOT A REQUEST FOR QUOTATIONS (RFQ). All responsible sources that can provide this supply may submit a capability statement that will be considered by email (subject line to reference NIAID-NOI20-2032299) to Julie Yun at julie.yun@nih.gov by 10:00AM EDT Thursday, September 10, 2020. All responses that meet the agency requirement and are received by the closing date of this Notice will be considered by the Government. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. Any response received after the closing date and time of this notice will be late and will not be considered. SPECIAL NOTICE Quoters are advised that the Government may share your information with non-government personnel who are assisting with the evaluation of responses. The exclusive responsibility for source selection will reside with the Government. By submitting your response, you consent to disclosure of your offer to non-government personnel for purposes of evaluation.
