The Centers for Disease Control and Prevention intends to award a sole source firm fixed price purchase order to Fidelis Sustainability Distribution LLC for providing the annual service agreements for the three (3) Fibroscan 302 Touch instruments manufactured by Echosens, Inc. These three instruments are used in the field in the three Mobile Examination Centers (MECs) as part of the National Heatlh and Nutrition Examination Survey (NHANES) for the liver elastography component. The manufacturer of the FibroScan 302 Touch instruments, Echosens, Inc., has entered into a partnership with Fidelis Sustainability, a SDVOSB, which gives Fidelis sole distribution rights in the United States. As a result of their contract, the service agreements for the FibroScan instruments are not available through other vendors in this country. On May 26, 2020, we asked both Echosens and Fidelis to confirm that their partnership still exists. Fidelis confirmed that they will continue to be the sole distributor of Echosens products in the United States. This contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.106-1(b) (SAP) and 10 U.S.C. 2304(c)(1). Interested parties may identify their interest and submit documentation of their capability to respond to the requirement. This notice of intent is not a request for competitive quotations; however, all responses received within ten (10) days of the issuance of this notice will be considered by the government. A determination by the government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
