The U.S. Food & Drug Administration (FDA) intends to issue a Sole Source award to Agilent Technologies, Inc. (“Agilent”) for procurement of One (1) Through-Barrier Capable Raman Spectrometer Agilent Vaya using SORS technology. The Government intends to issue a sole source award in accordance with FAR 6.302-1, only one responsible source and no other will satisfy the agency requirements for the above stated equipment. FDA program office is currently utilizing the Agilent Vaya system with SORS technology which is assigned for pandemic related testing projects. The FDA intends to add another Vaya system that will increase support for emergency related analytical testing so that testing may be performed in time. Since the FDA has established and validated analytical methods and protocols on the existing instrument Vaya system, FDA intends to utilize on-going tests and future tests utilizing the established methods for the new add-on system. Addition of the existing system will also ensure FDA test results are consistent with the established method validation and an up-to date system will expand functionality of the FDA goals. The SORS technology are protected by several patents. The Agilent Vaya system is a small size through-barrier capable instrument which is also portable/handheld SORS device culture module that is able to support the parameters set for the FDA research experiments. Agilent is the sole source manufacturer of the Agilent Vaya handheld Raman Spectrometer system. Agilent is the sole source for factory recommended replacement parts. Only Agilent or Agilent authorized support is capable of providing warranty, service, and replacement parts on Agilent products. This will be a firm fixed price award. However, all responsible sources may submit a capability statement to Sarah Hussain, sarah.hussain@fda.hhs.gov in writing and must be within 10 days after date of publication of this notice which may be considered by the agency. The capability statement shall include in subject line the FDA notice ID stated above, for any consideration. A determination by the Government not to compete as a result of information received is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No phone calls will be accepted.
