Description This is a Notice of Intent to Sole Source for Service Maintenance for the FACSAria II Special from Becton Dickinson Biosciences for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, “Streamlined Procedures for Evaluation and Solicitation for Commercial Items,” as supplemented with additional information included in this notice. The National Institute of Environmental Health Sciences (NIEHS) intends to award a Purchase Order to Becton Dickinson Biosciences, 2350 Qume Drive, San Jose, CA, 95131, for Maintenance to the Becton Dickinson FACSAria II instruments, which are installed at NIEHS, Research Triangle Park campus. The provided supplies and services are proprietary, and the services will be provided for the period of January 1, 2020 through December 31, 2020. The associated North American Industrial Classification System (NAICS) code for this procurement is 811219, with a small business size standard of $22.0 million dollars. NO SOLICITATION OR REQUEST FOR QUOTATION (RFQ) IS AVAILABLE. It has been determined that Becton Dickinson Biosciences is the only known responsible source capable of providing the required services for the FACSAria II instruments and no other services will satisfy the agency’s requirement. The purpose of this Purchase Order is for maintenance service to the Becton Dickinson Biosciences installed at NIEHS, RTP, NC. Alexander Drive Durham, NC 27709 General Instructions The selection of a source for award will be conducted utilizing Simplified Acquisition Procedures as delineated in FAR Part 13. The quoter will be evaluated using the criteria under FAR 52.212-2, “Evaluation--Commercial Items”. Noncompliance with the Request for Quote (RFQ) requirements may hamper the Government's ability to properly evaluate the quote and may result in elimination of the quote from further consideration for contract award. The Government intends to award without discussions but reserves the right to award with discussions. The quoter is encouraged to present their quote and prices in their initial quote submission. These instructions prescribe the format for the quote and describe the approach for the development and presentation of quote data. These instructions are designed to ensure the submission of necessary information to provide for the understanding and comprehensive evaluation of quotes. If the Quoter believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise unsound, the Quoter shall immediately notify the Contracting Officer in writing with supporting rationale. The Notice of Intent is not a solicitation or request for quotations. Notwithstanding, if any firm believes it is capable of meeting NIEHS’ requirement, as stated herein, they may submit their corporate capabilities, which, if received by the response date of this announcement, may be considered. Responses to this posting must be in writing and shall be via e-mail to Brian Moyer at moyer@niehs.nih.gov and are due no later than December 27, 2019 at 11:00 AM EST. A determination by the Government not to compete this requirement based upon responses to this notice is solely with the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
