The Department of Health and Human Services (HHS), National Institutes of Health (NIH), National Cancer Institute (NCI), Center for Cancer Research (CCR), Urologic Oncology Branch (UOB) plans to procure, on a sole source basis, maintenance service for two (2) Government owned Incucyte S3 HD/2CLR Instruments from: Sartorius Corporation 565 Johnson Avenue Bohemia, New York, 11716 The response close date of the notice for this requirement is in accordance with FAR 5.203(b). This acquisition will be processed under FAR Part 12 – Acquisition for Commercial Items and will be made pursuant to the authority in FAR Part 13.106-1 (b)(1), and is exempt from the requirements of FAR Part 6. The North American Industry Classification System code is 811210 and the business size standard is $34.0 Million. To NCI’s knowledge Sartorius is the manufacture and only source able to provide maintenance for the IncuCyte S3s located at the Urologic Oncology Branch (UOB). Any material or service must be compatible in all aspects (form, fit, and function) with the existing systems currently installed, and be able to connect or interface with other pre-existing systems. Only Sartorius, the original equipment manufacturer (OEM) of the IncuCyte S3, is capable of providing the support services because the equipment is proprietary to this company. As OEM-authorized service provider, Sartorius is the only source with direct access to OEM parts, propriety software, as well as factory trained technicians able to provide the services for the IncuCyte S3. Sartorius does not offer any parts or services to third party vendors, and Sartorius does not authorize any other vendors to perform services for their equipment. Use of any other vendor would jeopardize system functionality by risking hardware and software standards, could compromise system integrity and functionality, and void equipment warranties. This is turn would endanger the ongoing research at UOB. Therefore, Sartorius is the only source that can meet the Government’s at this time. This notice is not a request for competitive quotations. However, if any interested party, especially a small business, believes it can meet the Government’s needs, it may submit a capability statement, proposal, or quote for the Government to consider. The response and any other information furnished must be in writing and must contain sufficient details to allow NCI to determine if the party can perform the requirement. Responses to this notice shall be submitted via email to Contracting Officer, John Russell, at John.Russell3@nih.gov no later than 10:00 A.M. EST on Tuesday, June 06, 2023 (06/06/23). A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered for the purpose of determining whether to conduct a competitive procurement. The Government reserves the right to use the information provided by respondents for any purpose deemed necessary and legally appropriate.
