This announcement constitutes the only solicitation; quotations are being requested and a separate, written solicitation will not be issued. This solicitation, 75N91021Q00128, is issued as a request for quote (RFQ) and includes all applicable provisions and clauses in effect through FAR Federal Acquisition Circular (FAC) 2021-05 (3-10-2021), simplified acquisition procedures for commercial items. The North American Industry Classification System (NAICS) code is 334516 – Analytical Laboratory Instrument Manufacturing and the business size standard is 1,000 employees. Only one (1) firm fixed price purchase order award will be made as a result of this solicitation. 2.0 BACKGROUND The Department of Health and Human Services (HHS), National Institutes of Health (NIH), National Cancer Institute (NCI), Center of Cancer Research (CCR), Laboratory of Genome Integrity (LGI) is focused on the exploration of the causes and effects of genomic instability, mechanisms of DNA repair and the study of DNA repair as an initiating or protective event in aging and cancers. Based on the labs reported role of TRF2-independent telomere protection in pluripotent stem cells (Nature. 2020 Nov 25. doi: 10.1038/s41586-020-2959-4), LGI intends to focus on the changes in chromatin states associated with TRF2 depleted ES cells. Due to the sensitivity of the analysis, the required instrument will provide better temperature accuracy and precision. The equipment is critical for LGI’s project to check chromatin modification and gene expression levels in TRF2 depleted cells. 3.0 TYPE OF ORDER This is a Firm Fixed-Price Purchase Order. 4.0 SPECIAL ORDER REQUIREMENTS 4.1 PRODUCT FEATURES/SALIENT CHARACTERISTICS The following product features/characteristics are required for the CFX Opus Real-time PCR System or Equivalent. The instrument shall: • Include an optical system that is comprised of 5 separate LED channels and one FRET channel. The fluorescence resonance energy transfer (FRET) allows the detection of specific regions like centromeric repeat with TagMan probes to check chromatin modification and transcription levels in TRF2 depleted cells. • Provide temperature accuracy of no less than 89.5 °C and no greater than 90.5 °C to detect the target at 90 °C. This can distinguish small sequence differences on the genome such as sub-telomeric regions. • Be capable of assay optimization with thermal gradient covering 30 °C–100 °C, which allows the user to determine the optimal reaction conditions for a new or existing assay in one run vs many successive runs and experiments. • Be capable of detecting gene expression without the requirement of a passive dye such as ROX (6-carboxyl-X-Rhodamine), thus allowing comparison between independent qPCR assays. • Be able to fit in the available laboratory space of (WxDxH): 15x24x16 inches. 4.2 DELIVERY / INSTALLATION The Contractor shall deliver the equipment within 30 business days of the purchase order award. The Contractor shall coordinate delivery and tracking information with the NCI Technical Point of Contact (TPOC), TBD at award. All shipping/handling (including FOB) and delivery/installation fees shall be included. Upon delivery, the Contractor shall notify the TPOC to schedule installation. The installation date and time shall occur within 10 business days after delivery. Installation shall be performed by, or under the direct supervision of, an Original Equipment Manufacturer (OEM) certified operator. The Contractor shall deliver and install the equipment at the following address: CCR/NCI 37 Convent Drive Building 37, Room 2144B Bethesda, MD 20892 4.3 TRAINING The Contractor shall provide 1 hour of complete training for instrument operation to 5 NCI staff members at the above location within 30 business days of the installation of the instrument. 4.4 WARRANTY The Contractor shall warrant all supplies furnished under this purchase order against any defects in design, material, or manufacture for a period of at least 12-months from date of installation. The Contractor shall also warrant and imply that all items delivered as a result of this order are merchantable and fit for use for the particular purpose described in the order in accordance with FAR 52.212-4(o). The Contractor shall warrant that all consumables or expendable parts are free of defects in design, material or manufacture for a period of at least 90 calendar days from date of installation. Supplies which are repaired or replaced shall be warranted for the remainder of the initial warranty period or for 90-days – whichever is greater. 4.5 PROCEDURES DURING COVID-19 PANDEMIC Due to the current COVID-19 pandemic, the Contractor must pay close attention to the following delivery instructions. Please be aware that due to the fluidity of the existing pandemic, instructions may be updated as needed after award. - The equipment shall be delivered within the timeframe listed in section 4.2 above. - The Contractor shall: • Store or hold equipment until NCI is ready to accept the equipment at no additional cost; • The equipment shall not be sold to another business in the event NCI is not ready to accept delivery due to unanticipated changes related to COVID-19; and • Training as required by the Statement of Need shall be made available and provided to required staff at different times and dates, if required, at no additional cost. - Communicate and follow instructions from the TPOC to coordinate delivery, installation and training in accordance with the timeframes stated in sections 4.2 through 4.3 above. The delivery address and TPOC’s information will be provided at the time of award and must be included as part of the order/shipping label. - All companies delivering to NIH’s main campus shall comply with Commercial Vehicle Inspection Facility (CVIF) access procedures. CVIF will provide a list of buildings with loading docks. - Delivered items will be logged in and the loading dock Contractor or Government employee will attempt to contact the TPOC for inspection and acceptance of the package. In the event the TPOC is unable to accept the package, the equipment shall not be left at the loading dock station. The Contractor shall confirm another attempt will be made to deliver on another date, to be coordinated with the TPOC, at no additional cost. - Deliveries shall only be made between 6AM to 4PM, Monday through Friday. Note: Delivery personnel may be asked a series of questions related to recent travels and if any physical symptoms relevant to COVID 19 exist. 5.0 PAYMENT Payment shall be made after delivery, inspection and acceptance by the Government. Payment authorization requires submission and approval of invoices to the TPOC and NIH OFM, in accordance with the payment provisions listed below: The following clause is applicable to all Purchase Orders, Task or Delivery Orders, and Blanket Purchase Agreement (BPA) Calls: Prompt Payment (Jan 2017) FAR 52.232-25. II. Invoice Payment A. Except as indicated in paragraph B., below, the due date for making invoice payments by the designated payment office shall be the later of the following two events: 1. The 30th day after the designated billing office has received a proper invoice. 2. The 30th day after Government acceptance of supplies delivered or services performed. B. The due date for making invoice payments for meat and meat food products, perishable agricultural commodities, dairy products, and edible fats or oils, shall be in accordance with the Prompt Payment Act, as amended. III. Interest Penalties A. An interest penalty shall be paid automatically, if payment is not made by the due date and the conditions listed below are met, if applicable. 1. A proper invoice was received by the designated billing office. 2. A receiving report or other Government documentation authorizing payment was processed and there was no disagreement over quantity, quality, or contractor compliance with a term or condition. 3. In the case of a final invoice for any balance of funds due the contractor for supplies delivered or services performed, the amount was not subject to further settlement actions between the Government and the Contractor. B. Determination of interest and penalties due will be made in accordance with the provisions of the Prompt Payment Act, as amended, the Contract Disputes Act, and regulations issued by the Office of Management and Budget. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
