The Center for Disease Control and Prevention (CDC), National Center for Immunization and Respiratory Diseases Influenza Division (NCIRD/ID), intends to award a sole source purchase order in accordance with FAR 13.106-1(b)(1), soliciting from a single source, to BD Biosciences for maintenance and repair services of BD FACSDiscover™ S8 Cell Sorter, BD FACSymphony™ A5 Cell Analyzer, V96100418 (CII), and Lyric FACS: Z662876000047. These instruments are proprietary to BD. The NAICS code for this procurement is 334516, Analytical Laboratory Instrument Manufacturing. The purpose of this acquisition is to purchase a yearly maintenance service along with one preventative maintenance every year for BD flow cytometers, BD FACSDiscover™ S8 Cell Sorter, BD FACSymphony™ A5 Cell Analyzer, V96100418 (CII), and BD Lyric FACS: Z662876000047. These instruments are routinely used for analyzing samples from clinical trials; therefore, immediate repair, readily accessible service, and technical help are required to support the ongoing clinical trial needs. Additionally, BD Biosciences, the original equipment manufacturer (OEM), has a guaranteed response time of 48 hours, which will prevent delays to our projects. Software and hardware upgrades are proprietary to BD and will be installed at no additional cost. Further, BD will also provide unlimited application support that can only be provided by the original manufacturers. Consequently, BD is being considered for a sole-source award for this requirement. As a result of this notice, no competitive solicitation will be posted on SAM.gov. The government will issue only one solicitation to Formulatrix, LLC. However, firms that believe they can meet this requirement are encouraged to identify themselves and give written notice by providing a capability statement to the contract specialist, Dawnnia Daley, at xwf5@cdc.gov by July 26, 2024, at 5:00 p.m. EDT. The contract specialist will not respond to verbal requests. All requests must be in writing. A determination by the government not to take this proposed action will be based on responses to this notice and is solely within the discretion of the contracting officer. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
