The Center for Disease Control and Prevention (CDC), National Center for HIV, Viral Hepatitis, STD, and TB Prevention (NCHHSTP), Division of HIV Prevention (DHP), Translation and Evaluation Branch intends to award a sole source contract to Luther Consulting, LLC, 10435 Commerce Dr, Carmel, IN 46032 for the purchase of continued use of EvaluationWeb® for data management, reporting, and analysis of National HIV Prevention Program Monitoring and Evaluation (NHM&E) data. The services supported by the contract would include operation and maintenance of the vendor-owned and -hosted system, technical assistance to CDC and CDC-funded recipients, user set up for secure access to the system, and biannual data submissions to CDC. The statutory authority for this sole source acquisition is 41 U.S.C 3304(a)(1) in accordance with FAR Part 6.302-1- only one responsible source and no other supplies or services will satisfy the agency requirement. The NAICS code for this procurement is 541511 - Custom Computer Programming Services. The purpose of this acquisition is to provide continuous functionality, development, and support to National HIV Prevention Program Monitoring and Evaluation (NHM&E) activities, including data collection, management, reporting, and analysis, through the use of a web-based system, hereafter referred to as “NHM&E Data System” or “the system”. EvaluationWeb® is currently used by CDC-funded recipients to facilitate reporting of their required HIV testing and partner services data to CDC. EvaluationWeb® is a proprietary software product owned by Luther Consulting, LLC. Since 2012, Luther Consulting, LLC has provided EvaluationWeb® as a Software as a Service (SaaS) product for the collection and reporting of National HIV Prevention Program Monitoring and Evaluation (NHM&E) data requirements. The system is used by 60 CDC-funded health departments and over 100 CDC-directly funded community-based organizations (CBOs) that provide HIV prevention services to populations at greatest risk for acquiring and transmitting HIV infection. In order to maintain its Trademark validation and proprietary software code, security, and access, all aspects of the system including software code, development and updates, system architecture and system hosting can only be managed by Luther Consulting, LLC and its authorized staff. Therefore, Luther Consulting, LLC, the proprietary software product owner, is the only company that can be used. As a result of this synopsis, no competitive solicitation will be posted on Sam.gov. We will issue only one solicitation to Luther Consulting, LLC. However, firms that believe they can meet these requirements are encouraged to identify themselves and give written notice by providing a capability statement to the Contracting Officer by May 17, 2022. The Contracting Officer will not respond to verbal request. All requests must be in writing. A determination by the Government not to compete this proposed action will be based on responses to this notice and are solely within the discretion of the Contracting Officer.
