As to Solicitation pages 5, 6, and 17 of 42 (Introduction Section, Section B (Schedule of Supplies/Services), and Section D.2 (Scope of Work), respectively): Vendor’s Question: The Solicitation indicates that the government intends to issue a single delivery order and that the contractor must provide each of the pharmaceuticals identified in the Solicitation to be considered for award. The Solicitation also provides, however, that the “Government contemplates award of more than one firm fixed price contract resulting from this solicitation” and that the “Government intends to award multiple contracts. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations.” See Solicitation page 22 (Section E.2, Type of Contract & Products and Commercial Services (Nov 2021)). Please clarify whether the government is awarding one contract covering all items or, alternatively, if it is awarding contracts on a product by product basis. Government’s Response: REVISED TO: It is the intention of the Government to evaluate proposals and award a contract or contracts without conducting discussions with Contractors. The Government anticipates making one award for all products as a result of this solicitation. However, the government may make multiple or no contract award(s), if it is determined to be in the Government’s best interest. The Government’s intent is to award a contract without discussions as a result of the solicitation Notwithstanding , the government expressly reserves the right to conduct discussions. We anticipate that the value of this procurement will exceed the Trade Agreements Act (TAA) threshold. We request clarification as to whether the government’s position is that this procurement is subject to the Buy American Act or the TAA. Would the government consider striking this requirement from the Solicitation?
