This contract action is for the acquisition of supplies for which the Government intends to solicit and negotiate with only one source under the authority of Federal Acquisition Regulation (FAR) Subpart 13.106-1(b)(1). The National Institute of Environmental Health Science (NIEHS), Office of Acquisitions (OA) intends to award a single source purchase order to Agilent Technologies Inc., 2850 Centerville Road, Wilmington. DE, 19808-1610, for the acquisition of a Service Agreement for a Crosslab Silver Cryogenic System. The NMR Research Core Facility at NIEHS maintains 4 high field magnetic resonance instruments that are used for various chemical measurements primarily for the NIEHS Division of Intramural Research. These instruments are capable of determining molecular structures, analyzing macromolecules, and analyzing mixtures for metabolomic studies. Nuclear magnetic resonance spectroscopy (NMR) is a useful technique because it is information rich, but generally has poor signal to noise compared to other forms of spectroscopy. Therefore, the core purchase 2 cryogenically cooled cold probe systems (one for a 600 MHz system and one for an 800 MHz system) to enhance the signal to noise, which benefits all users of these instruments. This service contract serves to maintain current working status, on-site visits for repairs when necessary and software upgrades as needed. Failure to purchase this service agreement will mean that upgrades will not be performed and that service visits will need to be paid upon request, costing thousands of dollars for each visit. This service agreement will enable the equipment to operate at optimal levels and generate data comparable to what has been historically produced. Agilent Technologies, Inc., is the manufacturer and sole distributor for this instrument and parts, thereby not allowing third party entities to service their equipment. This requirement is for a Base + 2 Option Periods Base Period: August 20, 2023-August 19, 2024 Option Period 1: August 20, 2024-August 19, 2025 Option Period 2: August 20, 2025-August 19, 2026 Line item #1. NMR800-MY1443AB72, 7700cs Cryo Cooling System, 700MHz, Crosslab Silver Cyrogenic System Service Agreement- (Quantity 1 each). The applicable North American industry Classification System (NAICS) code for this procurement is 811210 “Electronic and Precision Equipment Repair and Maintenance.” Its associated Business Size Standard is $30.0 Million. NIEHS will solicit and negotiate directly with Agilent Technologies, Inc. and no solicitation will be issued. This notice of intent is not a request for competitive proposals or quotations; however, all responsible sources may submit a bid, proposal, or quotation which shall be considered by the agency. Offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. A determination by the Government not to compete this proposed requirement based on responses to this notice is solely within the discretion of the Government.
