This contract action is for the acquisition of supplies for which the Government intends to solicit and negotiate with only one source under the authority of Federal Acquisition Regulation (FAR) Subpart 13.106-1(b)(1). The National Institute of Environmental Health Science (NIEHS), Office of Acquisitions (OA) intends to award a single source purchase order to Percussion Software Inc., 100 Summit Drive/Suite 100, Burlington, MA 01803. The support and maintenance for this service is for Percussion Rhythmyx Server-Standard Edition for WCM-2 CPU Support and Maintenance—Test, Development and Production Servers. The NIEHS is transitioning off of the Percussion System, but currently is still in use for all NIEHS websites. This effort requires delegated ATO from NIH which NIEHS and NTP have been working on for more than a year. A legislation hold from HHS additionally requires the NIEHS to keep the Percussion files in their “native” format as they relate to PFAS communications. Technical Specifications: • Rhythmyx Enterprise Edition for WCM - 2 CPU, Support and Maintenance Renewal • Rhythmyx Test Server Standard Edition for WCM - 2 CPU, Support and Maintenance Renewal • Rhythmyx Shared Development Server - Standard Edition for WCM - 2 CPU Support and Renewal Period of Performance: July 1, 2022-May 20, 2023. The applicable North American industry Classification System (NAICS) code for this procurement is 511210 “Software Publishers.” Its associated Business Size Standard is $41.5. NIEHS will solicit and negotiate directly with Percussion Software, Inc., and no solicitation will be issued. This notice of intent is not a request for competitive proposals or quotations; however, all responsible sources may submit a capability statement which shall be considered by the agency. Offerors must have an active registration in the System for Award Management (SAM.GOV) www.sam.gov. A determination by the Government not to compete this proposed requirement based on responses to this notice is solely within the discretion of the Government. Interested parties must express their interest and must be submitted in writing via email to Valarie K. Sims at sims3@niehs.nih.gov and are due by 10:00 AM, June 22, 2022. No faxed documents will be accepted. If no responsive statements are received by the due date, an award will be made to Percussion Software, Inc.
