Notice of Intent to Sole Source BD Biosciences Preventative Maintenance Agreement Product Service Code: J066 NAICS Code: 811210 Place of Performance: Bethesda, MD 20892 USA POTS Number: 25-008306 Description: This is a Notice of Intent, not a request for quotation. A solicitation document will not be issued, and quotations will not be requested. The National Institutes of Health (NIH) intends to issue a firm-fixed-price purchase order to BD Biosciences, located at 2350 Qume Drive, San Jose, California 95131-1812, to procure a preventative maintenance agreement for one base period. The estimated period of performance is August 1, 2025 – July 31, 2026. Purpose: This acquisition is to secure maintenance services for the following instruments used in the Hematology Flow Cytometry Service: BD FACSLyric (Serial #: Z662383000112) Universal Loader (Serial #: Z662462000206) BD FACSDuet (Serial #: 9230010101) These services are critical to maintaining instrument functionality, supporting accurate and timely patient sample testing, and preventing costly disruptions due to malfunctions. The instruments are essential to the Department of Laboratory Medicine’s mission of delivering high-quality patient care, research support, and training. Justification for Sole Source: BD Biosciences is the sole manufacturer, supplier, and authorized service provider for these instruments. The required maintenance kits and service components are proprietary, and no other vendor is authorized or technically capable of supporting these systems. Using an alternative vendor could result in: Protocol cancellations Delays in patient testing Increased costs Wasted government resources This acquisition is being conducted using policies unique to the Federal Acquisition Regulation (FAR) Part 13 – Simplified Acquisition Procedures, Subpart 13.106-1(b)(1), For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstance of the contract action deem only one source reasonably available. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. The Government will consider all submissions received before the deadline; however, the final determination to proceed with a noncompetitive action is at the sole discretion of the Government.
