A solicitation document will NOT be issued, and quotations will NOT be requested. The National Institutes of Health (NIH) plans to issue a firm fixed-price purchase order to Intuitive Surgical Inc. 94086-5301. The Department of Laboratory Medicine is requesting a preventative maintenance agreement and the replacement of two (2) Intuitive Surgical Inc. Da Vinci XI 0° and one (1) Intuitive Surgical Inc. Da Vinci XI 30° Endoscopes®. The repair exchange is required because the scope located with the Urologic Oncology Branch is currently broken. The department performs an average of 7 robotic cases per week, and it takes 12 hours to turn over the scopes due to the drying time. These scopes are essential for Urology surgeons to conduct Laparoscopic Prostate and Nephrectomy surgeries using the DaVinci XI Robot. Without functional scopes, the surgeons will be unable to perform these critical procedures with the XI Robot, as these scopes are used in every DaVinci XI procedure. Intuitive offers a fixed-rate repair service for these scopes, and using an alternative repair company could void the warranty on the Preventative Maintenance Agreement. Product Number/Quantity/Description Da Vinci XI 0° Endoscopes®/2/SN: SF2007034, SN: SF1930795 Da Vinci XI 30° Endoscopes®/1/SN: SF10246184 Intuitive Surgical Inc is the exclusive manufacturer and registered trademark holder of Intuitive Surgical Inc. Da Vinci XI 0° and 30° ® and has the proprietary rights to these endoscopes. The da Vinci® Xi™ is CE marked and FDA cleared. Intuitive Surgical, Inc. exclusively owns all proprietary rights to the da Vinci® Xi™ Surgical Systems and instrumentation. Intuitive Surgical is the sole manufacturer of these systems and does not sell the equipment through any group purchasing organizations or distribution channels in the United States. Furthermore, Intuitive Surgical is the only authorized service provider for this equipment. There are known vendors that can provide maintenance to these proprietary endoscopes. This acquisition is being conducted using policies unique to the Federal Acquisition Regulation (FAR) Part 13 – Simplified Acquisition Procedures, Subpart 13.106-1(b)(1), For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstance of the contract action deem only one source reasonably available. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. The total dollar value of this requirement shall not exceed the Simplified Acquisition Threshold (SAT) $250,000.00. The determination by the Government not to compete the proposed requirement based upon responses to this notice is solely within the discretion of the Government.
