A solicitation document will not be issued, and quotations will not be requested. The National Institutes of Health, Office of Purchasing and Contracts on behalf of the Department of Laboratory Medicine intends to award a firm-fixed priced contract for twelve months to Siemens Diagnostics for the supply of reagents kits, quality control material and consumables for the Siemens Immulite 2000 XPi Immunoassay System. To maintain consistency with protocol guidelines only Siemens Diagnostics is the only source capable of meeting the governments requirement in its entirety by supplying compatible reagents and consumables with the Immulite 2000 XPi Immunoassay System. Proposed Contractor: Siemens Healthcare Diagnostics 511 Benedict Avenue Tarrytown, New York 10591-5005 The Department of Laboratory Medicine has a continued need for Siemens reagent kits, quality control material, and consumables compatible and for use only with the Siemens Immulite 2000 XPi in support of patient care. Siemens Immulite 2000 XPi Immunoassay System consists of a platform of eight (8) different test methodologies in the Chemistry Service to meet the needs of high volume and rapid turn-around times of patient tests. Siemens Healthcare Diagnostics. Inc. is the sole manufacture, supplier, and service provider of the Immulite 2000 XPi Immunoassay System, reagents, and consumables. Siemens Healthcare Diagnostics Inc. does not have any third-party service providers or distributors of its equipment or reagents. Any substitution in equipment, reagents, consumables or service will cause a stoppage of work and cancellation of the protocol or delays in providing test services that will negatively impact patient care and research studies. The proposed contractor is the only vendor uniquely qualified to provide the required reagents, consumables which are proprietary in nature and meet the government’s requirement without interruption or delay to patient care services. This acquisition is being conducted using policies unique to the Federal Acquisition Regulation (FAR) Part 13 – Simplified Acquisition Procedures, Subpart 13.106-1(b)(1), For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstance of the contract action deem only one source reasonably available. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. Interested parties may identify their interest and capabilities in response to this posting. The determination by the Government not to compete the proposed requirement based upon responses to this notice is solely within the discretion of the Government.
