A solicitation document will not be issued and quotations will not be requested. The National Institutes of Health (NIH) intends to award a fixed price contract to Becton, Dickinson and Company (BD Biosciences Business Unit) located in Franklin Lakes, JH 07417 on a sole source basis to provide quantity one (1) BD FACSLyric™ Cytometer located in the Critical Care Medicine Department (CCMD) at the NIH Clinical Center (CC). The purpose of this requirement is to acquire a new BD FACSLyric™ Cytometer to replace the current cytometer nearing the end of lifecycle. The current equipment is putting the agency at risk of becoming inoperable and failure which in turn will place clinical testing at risk in support of patient care. The new equipment must be compatible with existing government owned cytometers, reagents and consumables validated for patient testing, as well as the current software and the laboratory information system (LIS). Becton, Dickinson and Company (BD Biosciences Business Unit) is the sole manufacturer of the equipment, reagents, consumables, and are proprietary in nature. BD Biosciences do not have any authorized distributors and the only known sole capable of meeting the government requirement in its entirety. This requirement is for the purchase and installation of BD FACSLyric™ Cytometer at the National Institutes of Health. Quantity 1- BD FACSLyric™ FOB Destination Place of Performance: National Institutes of Health Clinical Center 10 Center Drive Building 10, Room TBD Bethesda, MD 20892 This acquisition is being conducted using policies unique to the Federal Acquisition Regulation (FAR) Part 13 – Simplified Acquisition Procedures, Subpart 13.106-1(b)(1), For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstance of the contract action deem only one source reasonably available. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. Interested parties may identify their interest and capabilities in response to this posting. The determination by the Government not to compete the proposed requirement based upon responses to this notice is solely within the discretion of the Government.
