This notice is a combined synopsis/solicitation for commercial items using Simplified Acquisition Procedures. This acquisition will be made in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6 “Streamlined Procedures for Evaluation and solicitation for commercial Items,” as applicable, and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation (a written solicitation will not be issued) and quotes are being requested. The Solicitation number is 22-011713 and the solicitation is issued as a Request for Quotes (RFQ). This acquisition will be processed under FAR Part 13 Simplified Acquisition Procedures (SAP). The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2022-06, May, 2022. The North American Industry Classification System (NAICS) code for this procurement is 334614, Software and Other Prerecorded Compact Disc, Tape, and Record Reproducing. The requirement is being competed with a brand name restriction, and without a small business set-aside. This solicitation is for renewing 42 Red Hat Linux licenses with support and smart management with Satellite to be installed on BTRIS servers. Specifications Red Hat Enterprise Linux Server Standard 9X5 Phone and Web Support. Smart Management with Satellite The government intends to award a firm fixed price purchase order to the responsible contractor as a result of this RFQ that will include the terms and conditions set forth herein. By submitting an offer in response to this RFQ, confirms acceptance that the government terms and conditions will prevail over the award. The National Institute of Health (NIH), Clinical Center (CC), intends to solicit a quote and enter into firm-fixed price to renew the 42 Red Hat Linux license, with Emergent. Red Hat maintenance licenses entitles the customer to upgrades, bug fixes, and new releases of the software. It also includes access to Red Hat’s technical support team as per Red Hat’s Standard Support Terms. Red Hat liceses include cloud management services, providing more comprehensive visibility into two key use cases: operational efficiency and security and compliance risk management. This acquisition is being conducted using policies unique to the acquisition of commercial items prescribed in FAR Part 12, in conjunction with the policies and procedures for the competition requirements of Part 6. Interested parties may identify their interest and capabilities in response to this posting. The determination by the Government not to compete the proposed requirement based upon responses to this notice is solely within the discretion of the Government.
