This acquisition will be made in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6 “Streamlined Procedures for Evaluation and solicitation for commercial Items,” as applicable, and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation (a written solicitation will not be issued) and quotes are being requested. The Solicitation number is 22-011577 and the solicitation is issued as a Request for Quotes (RFQ). This acquisition will be processed under FAR Part 13 Simplified Acquisition Procedures (SAP). The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2022-06, May, 2022. The North American Industry Classification System (NAICS) code for this procurement is 339112, Surgical and Medical Instrument Manufacturing. The requirement is being competed with a brand name restriction, and without a small business set-aside. This solicitation is to procure Genius 3 Thermometer with Base. Specifications 80 Genius 3 Thermometers with Base The government intends to award a firm fixed price purchase order to the responsible contractor as a result of this RFQ that will include the terms and conditions set forth herein. By submitting an offer in response to this RFQ, confirms acceptance that the government terms and conditions will prevail over the award. The award will be based on the following: the capability to meet the brand name requirement and price. The National Institute of Health (NIH), Clinical Center (CC), intends to solicit a quote and enter into firm-fixed price to purchase Genius 3 Thermometer with Base, with Cardinal Healthcare. The Clinical Center Standardized to the Cardinal Health Genius thermometers in 2001. The thermometers are part of many NIH protocols. The Genius thermometer is the sole tympanic thermometer in the CC. The Genius tympanic thermometer is the only thermometer that has Clinical repeatability in compliance to ISO 80601-2-56, UL listed Medical Grade device UL 60601-1-2:2014, Annually recertified field calibrator that electronically recalibrates the Genius thermometer, Ambient Temperature Target Temperature Accuracy, Ambient Air Pressure- Operating atmospheric pressure range from 70kPA to 106kPA, Response Time: 1 - 2 seconds, and Battery Life: Minimum of 15,000 temperature readings. This acquisition is being conducted using policies unique to the acquisition of commercial items prescribed in FAR Part 12, in conjunction with the policies and procedures for the competition requirements of Part 6. The determination by the Government not to compete the proposed requirement based upon responses to this notice is solely within the discretion of the Government.
