This is a notice of intent, not a request for a quotation. A solicitation document will not be issued and quotations will not be requested. The National Institutes of Health (NIH) intends to award a fixed price contract with one (1) twelve-month base year and two (2) twelve-month option periods to Becton, Dickinson, and Company (BD), Sparks, MD 21152 on a sole source basis. The purpose of this requirement is for BD to provide a comprehensive service agreement for BD proprietary instruments and computer system currently located in the Department of Laboratory Medicine (DLM), Microbiology Service at the NIH Clinical Center (CC). The Microbiology Service within the DLM requires the establishment of a service agreement for the proprietary BD BACTEC FX and MGIT instruments, and the EpiCenter computer system. The aforementioned instruments provide automated detection of pathogenic organisms in clinical patient specimens, and the generated results directly influence the treatment of patients in the CC. The intention of the comprehensive service agreement is to ensure that these instruments and the computer system continue to perform at their highest level in order to continue providing timely results to the patient care team. Because this requirement involves technology that is proprietary to BD, no other vendor can provide the service required for the BD BACTEC FX and MGIT instruments and EpiCenter computer system. This acquisition is being conducted using policies unique to the Federal Acquisition Regulation (FAR) Part 13 – Simplified Acquisition Procedures, Subpart 13.106-1(b)(1), For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstance of the contract action deem only one source reasonably available. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. Interested parties may identify their interest and capabilities in response to this posting. The determination by the Government not to compete the proposed requirement based upon responses to this notice is solely within the discretion of the Government.
