The Centers for Disease Control and Prevention, National Center for State, Tribal, Local, and Territorial Public Health Infrastructure and Workforce (PHIC), Division of Partnership Support (DPS), Office of Public Health Law Services (OPHLS)1600 Clifton Road, Atlanta, GA 30222, hereby announces its intent to issue a sole source modification in accordance with FAR 6.302-1, Only One Source, to West Publishhing Corporation, 610 Opperman Drive, Eagan, MN 55123, to acquire systematic online legal research and database software. The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(1) as cited in FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements." West Publishing Corporation’s software allows for systematic online legal research and database software. This platform is highly configurable and allows for customization and optimization of forms. The primary purpose for requiring only this software is due to compatibility with existing systems, laboratories, processes, and procedures. CDC’s existing processes have evolved around their use of West Publishing Corporation’s software and would require a significant investiment of time of money to reconfigure. Further, CDC’s partners already use West Publishing Corporation’s and using a different software program would reduce the ability of these groups to work collaboratively and efficiently. Responsible sources that believe they possess the expertise and capabilities identified above are encouraged to submit to the Contracting Officer within 5 days from the posting date of this notice, their written capabilities statement, proposal or quotation which shall be considered by the agency. All vendors must be registered in the System for Award Management (SAM) prior to an award of a federal contract. The website is: www.sam.gov. The Government will review any/all capabilities statements and pricing information submitted and determine if other qualified sources do exist that could provide this requirement in the future. Information received in response to this announcement will be used solely for the purpose of determining whether to conduct a competitive procurement in the future.
