This is a notice of intent that confirms the U.S. Department of Energy (DOE) Office of Headquarters Procurement Services’ (MA-64) intends to proceed with a single source acquisition pursuant to FAR 13.106-1(b) as there is only one responsible source that can provide the required services. MA-64 intends to solicit and negotiate with Portfolio Media, Inc, in accordance with 41 U.S.C.1901. The anticipated Contract period of performance is one (1) base year, four (4) option years, and the option period up to six months pursuant to FAR clause 52.217-8. This notice is being provided pursuant to FAR subparts 13.105, 5.203(a) and 5.204. This proposed action is for the procurement of an annual subscription for 7 Office of the Chief Information Officer (OCIO) users at enterprise level from Portfolio Media, Inc to receive the following proprietary publication: Law360.com (Law360). Law360 provides coverage on litigation, legislation, regulation, compliance & enforcement. It is unique in the focus and depth of coverage on issues germane to: Cybersecurity/privacy, Energy and Telecommunications practice areas. These practice areas are relevant to the OCIO. This publication provides mission-critical information on developments across a combination of legal sections not found with any one publication. Top executives in the Department of Energy require subscriptions to this publication in order to most effectively carry out the OCIO mission. Only one responsible source and no other supplies or services can satisfy any agency requirements in accordance with 41 U.S.C. 3304(a)(1). The anticipated North American Industry Classification System Code (NAICS) is 511120 – Periodical Publisher; Business size standard 1000 employees. This notice of intent is for information and planning purposes only. This notice does not constitute a formal request for quotation (RFQ) and any responses to this notice will be treated as information only. No RFQ exists; therefore, do not request a copy of a RFQ. No award will be made as a result of responses to this notice. Contractors are advised that the Government is not under any obligation to provide any responses as a result of this notice, nor is the Government bound to any further actions related to this matter. The information provided in this notice is subject to change and is not binding on the Government. If a firm believes the DOE should not pursue a contract with Portfolio Media, Inc. then they should submit a capability statement no later than 8 AM. A determination by the Government to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government.
