The United States Army Corps of Engineers (USACE) Engineering Research and Development Center-Construction Engineering Research Laboratory (ERDC-CERL) has a requirement for renewal of their annual subscription to the Westlaw Enflex regulatory database. This requirement will include a base year and four option years. ERDC-CERL intends to sole source this acquisition in accordance with FAR 13.106-1(b)(1) to West Publishing Corporation (Westlaw) as the company is the sole provider of the Enflex EDGE environmental regulatory database. ERDC-CERL has used Enflex for regulatory research for over 26 years; our updating process is closely interwoven with the way the Enflex updates the state environmental regulations. Enflex itself is based on the CELDS database developed by CERL through the University of Illinois (U of I), and operates in a fashion based on how CERL does regulatory updates. CERL researchers have looked for alternative sources of regulatory updates over the years, but have yet to find a suitable substitute. Westlaw’s database includes contents such as full American legal reports and GAO legislative history. In addition, Westlaw has recently added features that are helpful to research needs. For example, the EDGE features allowing on-the-fly comparisons of previous versions of any statute or regulation throughout its history. EDGE also tracks requests for regulation changes that have been submitted by agencies nationwide and are under review. No other sources include all of this information in one consolidated database. This is not a request for proposal and in no way obligates the Government to award any contract. The associated North American Industry Classification System (NAICS) code is 519130, Internet Publishing and Broadcasting and Web Search Portals which has a size standard of 1000 employees. This is not a small business set aside. Any interested party that believes they can fulfill this requirement should submit a capability statement to be reviewed. All submissions will be considered, however there is no guarantee that submissions in response to this notice will in any way alter the Government’s acquisition strategy. Responses to this notice will not be considered as a response to any solicitation, a request to be added to a prospective offerors list, or to receive a copy of any solicitation. A determination by the Government not to compete the contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
