The U.S. Army Corps of Engineers (USACE), Engineer Research and Development Center (ERDC), Construction Engineering Research Laboratory (CERL) intends to award a contract on a sole source basis to Bruker Scientific LLC in accordance with FAR 13.106-1(b)(1). ERDC-CERL has a requirement to upgrade the current Bruker FTIR Tensor 37 instrument with the following requirements and accessories: The instrument control software must be upgraded to work with new accessories and new performance features. The software upgrade must be performed by a certified service technician from Bruker. The data system must be upgraded to be compatible with and run the software version. The minimum specifications for the data system include an Intel i7 processor, 3GHz or better, 16GB RAM, 256GB SSD, 1TB hard drive, CD/DVD writer, 2 or more USB 3.0, 4 or more USB 2.0, 2x RJ-45 network, 2 DisplayPort, 2 or more PCIe, and Windows 10 OS. A compatible joystick capable of stable and controllable positioning of the Bruker Hyperion FTIR microscope component. The joystick must include a controller and cable and must be compatible with the new software and data system. Bruker Scientific LLC. and its employees are the sole source for the software, parts, repair and service of all Bruker Scientific instruments. Bruker Scientific LLC engineers are trained and certified to repair and service Bruker Scientific LLC equipment. Software and parts specific to Bruker instruments and services are only available through Bruker Scientific LLC. Planned maintenance is recommended to certify that the instrument is operational within specifications. Warranty and/or service contract coverage is void if any maintenance and product are performed by any other service provider. The associated North American Industry Classification System (NAICS) code is 334516, which has a size standard of 1000 employees. This Notice of Intent is not a request for competitive quotations. However, interested parties may identify their interest and capability to respond to this requirement. Any interested party that believes they can fulfill this requirement should submit a capability statement to be reviewed. All submissions will be considered, however there is no guarantee that submissions in response to this notice will in any way alter the Government's acquisition strategy. Responses to this notice will not be considered as a response to any solicitation, a request to be added to a prospective offerors list, or to receive a copy of any solicitation. A determination by the Government not to compete the contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Note: In order to be eligible for award of a Government contract, vendors must be actively registered in the System for Award Management (SAM), have no active exclusions, and complete the FAR and DFARS representations and certifications.
