Description: The U.S. Army Corps of Engineers, New England District is issuing this Sources Sought Announcement to determine interest, availability, and capability of 8(a), HUBZone, Service-Disabled Veteran-Owned, Woman-Owned and Small Business concerns to perform the work described below under an Indefinite Delivery/Indefinite Quantity (IDIQ) Remedial Action Contract (RAC). The U.S. Army Corps of Engineers, New England District desires to identify contractors capable of providing Environmental Remediation Services for the excavation and on-site capping of metals contaminated waste rock, tailing, sediment and soils, as well as the permanent closure of specific shafts and adits at the Ely Copper Mine Superfund Site as described in the Record of Decision for OU1, 2 and 3. The value of the construction project is expected to be in the $20M - $30M range. The NAICS code for this procurement is 562910 (size standard <750 employees). Remediation field work is expected to begin in 2024 and be completed within 3-5 years. Contract Line items (CLINs) will likely be a mix of fixed price line items and clearly defined, separable cost reimbursable line items. Responses to this sources sought announcement will be used by the Government to make appropriate acquisition decisions. After review of the responses to this announcement, and if the Government still plans to proceed with the acquisition, a solicitation announcement will be published in the https://sam.gov/ website for the respective project. NO SOLICITATION IS CURRENTLY AVAILABLE. All interested offerors will have the opportunity to respond to the solicitation announcement at a later time. Project Information: The Project Site, The Ely Copper Mine, is an abandoned copper mine located in Vershire, Orange County, Vermont and encompasses approximately 350 acres where historic mining activities took place. This includes about 30 acres of waste material containing an estimated 172,000 tons of waste rock, tailings, ore roast beds, slag heaps and smelter wastes. The Site also includes over 3,000 linear feet of Underground Mine Workings along with the associated shafts and adits. No buildings remain at the Site. Remnant foundations, pads, and stone walls, including a 1,400-foot-long smoke flue, demark the location of the former Site structures including a former flotation mill and the smelter plant. The contemplated work is associated with Operable Units (OU) 1, 2 and 3. OU1 includes areas that are the primary source of the surface water and sediment contamination to Ely Brook, Pond 4, Pond 5 and Schoolhouse Brook. OU2 includes the Underground Workings on the southern side of Dwight Hill and approximately 12 shafts, adits, vents, or other openings. OU3 includes the Underground workings on the northern side of Dwight Hill. There are no surface features in OU3. The selected remedy for OU1 is a comprehensive approach that addresses all current and potential future risks caused by contaminated soil, waste rock, tailings, surface water, and sediment in the OU1 area of the Site. Specifically, this remedial action includes: the excavation of about 107,000 cubic yards (cy) of contaminated waste rock, soil, and sediment with the consolidation of this material under a cover system in an on-site containment cell; and the excavation of about 4,000 cubic yards of contaminated tailings from the Tailings Area (TA) and consolidation under a cover system. The selected remedy for OU2/OU3 includes a passive surface water treatment system to treat the discharge from the Main Adit without changing the air flow in the Main Shaft and the permanent closure of the Deep Adit by filling in-place with grout and/or flowable fill to reduce or eliminate Acid Mine Drainage (AMD). The other mine features will be filled unless they are determined to be hibernacula for the state- or federally listed threatened or endangered bats. All work will be performed in accordance with CERCLA, the OU1 Record of Decision signed in September 2011, the OU2/3 Record of Decision singed in June 2016, and the OU1 Explanation of Significant Differences signed in September 2019, and EPA green and sustainability principles. Responses: In order that we may assess your capability to perform this contract adequately, interested firms should submit a capabilities package to include, at the minimum, the following: Firm’s name, address, point-of-contact, phone number, email address, CAGE and SAM.gov Unique Entity Identifier. Business classification (e.g., small business, veteran-owned small business (VOSB), Service-disabled veteran-owned small business (SDVOSB). Project overview and description for up to five (5) sample mine remediation projects comparable in scale and complexity to the project described above that were completed within the past seven (7) years. The project overviews shall include a synopsis of the project including project name, client, photos, month/year the firm’s work started and completed; total contract value of the firm’s work specifically; physical size of the impacted area; construction cost; and customer point-of-contact. A table indicating whether the sample projects included any of the following elements: Excavation of contaminated waste rock, soil and sediment in a mine waste environment. Construction of on-site containment cells for mine waste. Design and installation of passive surface water treatment systems for AMD. Working with threatened and endangered bats. Permanent closure of adits and shafts. Management of cost-plus projects. Installation of a low-permeability cover systems which include geosynthetics, geotextiles, and/or geocomposites; Installation of a horizontal and vertical drain systems. Development of a Failure Modes and Effects Analysis in accordance with EPA guidance: Planning for Response Actions at Abandoned Mines with Underground Workings: Best Practices for Preventing Sudden, Uncontrolled Fluid Mining Waste Releases, OLEM 9200.3-118, July 2017. A description of the firm’s in-house capabilities to accomplish the above stated work requirements and how the firm will meet or exceed the requirements for Federal Acquisition Regulation (FAR) 52.219-14 “Limitations on Subcontracting”. It should also describe the plan/method to be used in selection of team subcontractors for disciplines not provided by in-house resources to ensure appropriate level of experience and quality of work. Firm’s ability to provide binding rates for personnel labor and equipment and to certify cost and pricing data (via an approved accounting system) in compliance with FAR 52.215-20. Any advice you would give the Government in planning for the procurement of the contract and for construction execution.
