ACQUISITION SET ASIDE: This acquisition is 8(a) Small Business Set-Aside. Request For Proposal (RFP) will be evaluated by using the Lowest-Priced Technically Acceptable. Firms must be considered an 8(a) small business for the designated NAICS in SAM.gov. The North American Industry Classification System (NAICS) code for this requirement is NAICS Code 562998 - All Other Miscellaneous Waste Management Services. The small business size standard for this requirement is $16.5M. The PSC Code is ZIPZ is Maintenance of Other Non-Building Facilities. Small Businesses are reminded under FAR 52.219-14, Limitations on Subcontracting that it will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract. CONTRACT TYPE: USACE Los Angeles District plans to award a 5-year maintenance services contract not to exceed $49.5M. This service contract will be a Single Award Task Order Contract (SATOC) Indefinite Delivery, Indefinite Quantity (IDIQ) to provide for an indefinite quantity of supplies or services over a fixed period-of-time. Task order projects will vary in size, but the order limitation of task orders shall range between $2K and $5M. Task orders issued under this SATOC will be firm-fixed price and may include optional bid items. To meet the minimum guarantee, the Government anticipates awarding the first task order at time of contract award. 4. SELECTION PROCESS: This procurement will be conducted in accordance with FAR 15.101-2 Lowest price technically acceptable source selection process. The Government will evaluate the offerors’ Technical Acceptable and Past Performance as submitted in response to the solicitation and will award the contract to the responsible offeror, whose proposal conforms with all the terms and conditions of the solicitation and whose proposal is determined to represent the overall "best value" to the Government. Both a technical and price proposal will be required. The Technical Evaluation Factors for this procurement are identified in Section M, entitled Evaluation Factors and Basis Of Award. There will be one Pricing Schedule for the SATOC for disciplines, which will have a Performance Period of 5 years after contract award and one Pricing Schedule for the First Task Order, which will have a Performance Period of 365 days for the base year and four one-year options. It is the Government’s intent to award based on initial offers without discussions; therefore, the offerors shall provide their best technical and price proposals. The offerors will provide a quality control plan and a work plan for evaluation in accordance with EM 385-1-1, dated 2014. 5. PROJECT DESCRIPTION OF FIRST TASK ORDER FOR THE SANTA ANA RIVER MARSH (SARM): Provide all labor, materials, equipment, transportation, supervision, and non-personal services to perform the tasks and meet all performance requirement standards for the Level 1 and Level 2 work requirements. Work must be performed in accordance with all applicable national, state, and local codes. The Government will not provide any equipment or materials to the Contractor with the exception of USACE locks and keys for access gates, only after the Contract is awarded, unless directed earlier by the (KO). The Vendor will perform Trash Removal, Inspections, and Reporting for the 92-acre SARM as outlined in the Draft Habitat Management Plan (HMP). Trash Removal: The Contractor will remove all trash from the accessible intertidal areas by non-motorized boat and from the hard-to-reach locations once a week by foot. The Contractor will not perform trash removal by non-motorized boat between 14-February thru 16-September. To keep the 92-acre SARM free of waste debris, the contractor will collect trash and debris from the non-water and shorelines areas at least once a week and more frequently as necessary. The QC and biologist will instruct the maintenance staff on the SARM's specific nesting practices and riparian species habitat. They are in charge of making sure that no take is sanctioned by the maintenance teams' activities and conduct. Trash will include general waste, household hazardous/special waste (e.g., batteries, containers of fuel, paint, etc.), human and animal biological wastes, combustible and noncombustible rubbish, recyclables, non-CRV recyclables, tires, E-waste, medical wastes, used oil, homeless encampment debris, floating debris, and dead animals. The Contractor will take pre-cautions to minimize vegetation trampling when removing trash in sensitive species habitat (e.g., pickleweed and cordgrass habitats). The Contractor will pay special attention to the tide gates, side drains, outlets, and culverts to remove blocked debris promptly. All trash will be removed the same day from the SARM location any Contractor’s temporary dumpster locations must be approved by the Contracting Officer Representative (COR) prior to placement. The Contractor will be responsible for removal of abandoned/stolen vehicles, boats, motor bikes, trailers by coordinating with local towing companies and local law enforcement. Inspections: The Contractor will perform inspections during trash removal activities. Inspections will include visual inspections of locations of habitat damage by erosion, vandalism, or other causes; locations of trail segments in need of repair; identification for signs of use or damage (e.g., construction of ramps, barriers, or forts, presence of planted non-native plants, cut fences, etc.). The Contractor will promptly inform the COR if trespass or evidence of trespass are observed. Reporting: The Contractor will submit monthly inspection reports documenting visual inspections. The COR may have the Contractor revise monthly inspection reports based on the Government’s needs at no additional costs. The monthly inspection reports will be provided by the 5th day of the month and consists of visual inspections listed above and the below information. • Map identifying locations of visual inspections. • Photos of visual inspections containing date and time. • Quantity of trash removed measured by weight or volume. • List each type of trash separately noting the disposal or diversion date. Dumpster Management: The Vendor will perform Dumpster Management for the SARM and other work areas within USACE Los Angeles District’s O&M Area of Responsibility (AOR). The COR will coordinate with the Contractor for delivery locations and types and quantities of dumpsters required. Dumpster Management will include transportation, delivery, pickup, and all associated fees (e.g., dumping fees). The Contractor will provide dumpster to work areas specified by the COR not to exceed 10-CYs each month or 120 CY annually. 10-CY dumpsters may be required for sediment and concrete debris removal efforts. If Dumpster Management is not required for any month within the Contract Period of Performance (POP), then the total dumpster volume not required from the subsequent month will be carried forward monthly until the debris volume is expended. The Contractor will submit invoices monthly by the 5th of each month based on the volume of Dumpster Management services provided. 6. SAM.GOV SOLICITATION WEBSITE: The solicitation will be available on or about 17 August 2023. If the Government elects to conduct a pre-proposal conference and site visit for first task order, it will be conducted on 29 August 2023. The official solicitation and amendments, when posted, will be available by electronic posting only and may be found at http://www.SAM.gov/ Paper copies of the solicitation will not be issued. Telephone and Fax requests for this solicitation will not be honored. To download the solicitation for this project, contractors are required to register at http://www.SAM.gov/. This will be the only method of distributing amendments prior to closing; therefore, it is the Offerors responsibility to check the website periodically for any amendments to the solicitation. 7. SYSTEM FOR AWARD MANAGEMENT (SAM) REGISTRATION REQUIREMENT: Offerors shall have and shall maintain an active registration in the SAM database at http://www.sam.gov to be eligible for a Government contract award. If the Offeror is a Joint Venture (JV), the JV entity shall have valid SAM registration in the SAM database representing the JV as one business/firm/entity.
