The U.S. Army Corps of Engineers, Engineer Research and Development Center (ERDC), Coastal and Hydraulics Laboratory (CHL) intends to award a contract on a sole source basis to ICAN, Inc. upon the basis of the authority provided at FAR 13.501(a)(1). The ERDC-CHL has a need to maintain the Lock Operations Management Application (LOMA) system software in operational status; ensure software updates are properly developed and delivered; ensure updates to LOMA software are completed to ensure operation with any operating system or other software environment updates. This requirement would involve the development and implementation of enhancements as identified by LOMA users and program management. The ERDC-CHL issued a contract in 2009 with CNS Systems (then ICAN USA) for initial development of LOMA. In 2011, a second contract was put in place to continue development of LOMA and deliver the second version of the software. A third contract to update LOMA and add new features was awarded and delivered at the end of FY15. A fourth contract was put in place in 2019 to provide a substantially updated system. Since 2011, annual warranty contracts have been awarded to provide system support and incremental updates to address identified issues. This contract action will expand the scope to include development and implementation of system enhancements as identified by USACE. Due to the proprietary nature of the system, ICAN, Inc. is the only source that can satisfy the Government’s requirement. The associated North American Industry Classification System (NAICS) code is 517919, which has a size standard of $35.5M. This Notice of Intent is not a request for competitive quotations. However, interested parties may identify their interest and capability to respond to this requirement. Any interested party that believes they can fulfill this requirement should submit a capability statement to be reviewed. All submissions will be considered, however there is no guarantee that submissions in response to this notice will in any way alter the Government's acquisition strategy. Responses to this notice shall be submitted NLT 12:00 PM CST, 16 August 2021 to kasey.davis@usace.army.mil Telephone responses will not be accepted. Responses to this notice will not be considered as a response to any solicitation, a request to be added to a prospective offerors list, or to receive a copy of any solicitation. A determination by the Government not to compete the contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Note: In order to be eligible for award of a Government contract, vendors must be actively registered in the System for Award Management (SAM), have no active exclusions, and complete the FAR and DFARS representations and certifications.
