SOLE SOURCE ANNOUNCEMENT Introduction This is a follow on notice to the cancelled Pre-Solicitation Notice Number: W912DW21B0001 issued 01 February 2021. The U.S. Army Corps of Engineers (USACE) Seattle District intends to issue a solicitation and award of a sole source contract to North Wind Construction Services, LLC to renovate the Disposition Services Warehouse and Support Systems at Fort Bragg, NC under Notice Number W912DW21R0024. Authority DFARS 219.800 and 13 CFR 124.506(a)(4) Reasons for Sole Source Pursuant to DFAR 219.800(a): By Partnership Agreement (PA) between the Small Business Administration (SBA) and the Department of Defense (DoD), the SBA has delegated to the Under Secretary of Defense its authority under paragraph 8(a)(1)(A) of the Small Business Act (15 U.S.C. 637(a)) to enter into 8(a) prime contracts, and its authority under 8(a)(1)(B) of the Small Business Act to award the performance of those contracts to eligible 8(a) Program participants. (b) Contracts awarded under the PA may be awarded directly to the 8(a) participant on either a sole source or competitive basis. The estimated dollar value of this procurement is between$1,000,000 and $5,000,000. The assigned NAICS code is 236220, with a corresponding size standard of $39.5 million. Pursuant to 13 CFR 124.506(a)(2), a procurement offered and accepted for the 8(a) BD program must be competed among eligible Participants if: (i) There is a reasonable expectation that at least two eligible Participants will submit offers at a fair market price; (ii) The anticipated award price of the contract, including options, will exceed $7,000,000 for contracts assigned manufacturing NAICS codes and $4,000,000 for all other contracts; (iii) The requirement has not been accepted by SBA for award as a sole source 8(a) procurement on behalf of a tribally-owned or ANC-owned concern. As this requirement is less than the applicable competitive threshold amount, this requirement will be solicited and awarded as sole source contract pursuant to 13 CFR 124.506(a)(4). In accordance with Section 8(a) of the Small Business Act (15 USC 637(a)(1)) and the Federal Acquisition Regulation (FAR) Part 19.8, and the executed Partnership Agreement (PA) between the U.S. Small Business Administration (SBA) and the Department of Defense, the SBA accepted this requirement for sole source acquisition on behalf of North Wind Construction Services, LLC.
