This is a combined synopsis/solicitation for commercial services prepared in accordance with Federal Acquisition Regulation (FAR) Part 13 and Subpart 12.6, as supplemented with additional information included in this notice. Proposals are being requested and a formal written solicitation will be included as part of this submission. (SEE ATTACHED SOLICITATION). This office will not accept any telephonic, written, or faxed requests for a copy of the solicitation. The official media of distribution for this RFQ is the web. The Solicitation Number for this acquisition is W912BU21Q0011 and a separate attachment is issued as a Request for Quote (RFQ). This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-101, dated 10-26-2018. The U.S. Army Corps of Engineers, Philadelphia District, intends to award a firm fixed price contract for the contractor to provide herbicide spraying for Northern Area Dams in accordance with Performance Work Statement (PWS). Performance Work Statement Spraying of Herbicide at Prompton, Jadwin, Beltzville and Francis E. Walter Dams, PA Introduction Background. The US Army Corps of Engineers Philadelphia District has 5 multipurpose flood control projects located within the Delaware River Basin. While operating and maintaining these earth fill structures, it is critical to manage the spread of unwanted woody vegetation on the dam’s critical areas. This contract will service 4 of the 5 projects including Beltzville Dam, Lehighton PA, Francis E. Walter Dam, White Haven PA, General Edgar Jadwin Dam, Honesdale PA, and Prompton Dam, Prompton PA. Scope of Work. Every two years, the Northern Area Dams require a contracted herbicide spraying program to effectively control woody vegetation on the site’s embankments, groins, abutments, and 15ft beyond all contact points. This helps ensure the integrity of the earth filled structure. This program also serves as a way to control invasive plant species and the spread of unwanted phragmites while aiding to reduce maintenance efforts at each project. General Requirements A herbicide spraying contract shall be provided at Beltzville Dam, Francis E. Walter Dam, General Edgar Jadwin Dam, and Prompton Dam (hereafter referred to as “dams”) as described in the following sections. General. The Contractor agrees to furnish services as described in Section 3, Performance Requirements. This contract will cover the period beginning 1 June 2021 through 15 July 2021. Government-Furnished Materials. The Contractor is expected to provide all manpower, equipment, supplies, and materials required to deliver the herbicide spraying service. Contractor Personnel, Disciplines, and Specialties. The Contractor must be certified by the State of Pennsylvania for application of proper pesticides within the State and must adhere to all rules and regulations relating to pesticides. A copy of the appropriate certifications shall be furnished to the Contracting Officer’s Representative prior to commencement of work. The Contractor shall be provided with the appropriate form (Pesticide Application Record) to maintain herbicide records. This form shall be completed and furnished to the Government Representative upon completion of each site or day. The following Pesticide Application Record shall have the following information: Name of applicator and Certification ID. No. Herbicide name and EPA Reg. No. EPA Registration number Weather conditions Amount of herbicide used, date and time applied Amount of acreage covered Locations applied to include zip code Location and Hours of Duty. The Contractor shall perform work only during normal Corps of Engineers duty hours (7:00 am. to 3:30 pm., Monday thru Friday, excluding national holidays) weather permitting. Exceptions to this condition must be approved in advance by the Contracting Officer’s Representative. At least five (5) days’ notice shall be given to the Government indicating when spraying is to be performed at each location. Performance Requirements. The Contractor shall furnish all labor, supervision, equipment and supplies to provide spraying of an estimated 11,000 gallons of herbicide solution. Spraying will be conducted on each of the project site’s dam embankments, groins, abutments, and 15ft beyond contact points, and additional areas as specified below. Services shall be provided from 01 June 2021 to 15 July 2021. All work shall be in accordance with these specifications and as directed by the Contracting Officer’s Representative. Herbicide Requirements. Herbicides, Surfactant, Anti-Drift and Colorant used shall be as specified hereunder. NO SUBSTITUTIONS ARE PERMITTED TO THE PRODUCTS AND CHEMICALS LISTED BELOW. Herbicide, Oust XP, Mfg. Bayer, EPA Reg No. 432-1552. Provides 10-12 months of residual control of grasses, broadleaf weeds and woody brush. Herbicide, Escort XP, Mfg. Bayer, EPA Reg No. 432-1549. Targets woody brush and growth with no residual control. Herbicide, 2,4-D LV4, Mfg. Winfield Solutions LLC, EPA Reg No. 1381-102. Increases the spectrum of control on broadleaf weeds and woody brush. Surfactant, Cleancut, Mfg. Armorchem. Ensures thorough spray coverage. Colorant, Bulls Eye Pattern Indicator, Mfg. Milliken Chemicals, Inc. Provide visual pattern to identify thorough spray coverage. Anti-Drift agent. Aids in spray deposition Solution Mixture. Solution to be mixed per 100 gallons of water: Oust XP, 5 oz. Escort XP, 2 oz. 2, 4-D LV4, 1 gallon. Surfactant, 64 fl. oz. Bullseye Pattern Indicator, 10 fl. oz. E. Anti-Drift Agent, 1 gallon. Rate of Spray. Apply the above solution at a minimum spray rate of 100 gallons per acre, to assure a thorough and uniform covering of the vegetation surface. Areas of Coverage. The spraying of the herbicide solution mixture per the required spray rate noted above shall occur at the following projects (see attached maps in Appendix A for each site): TABLE INCLUDED WITH ATTACHMENTS Special Requirements It is highly recommended that the Contractor inspect all areas to be sprayed. In general, the areas include both the upstream and downstream portions of the dam embankments in addition to the specified areas listeD in the comments section under 3.4, Areas of Coverage, see above. The Contractor is required to furnish a minimum of TWO spray rigs with a minimum of FOUR trained competent individuals on site DURING SPRAYING OPERATIONS. This requirement ensures the period of performance is met at all four locations. The spray rig tanks must be equipped with an anti-siphon device. Spray guns shall be required to accommodate a variety of different spraying techniques. (The gun shall be required to spray a wide swath pattern that is uniform across its width and achieve applying a spray solution at 100 gallons per acre or concentrate the spray pattern for spot treatment.) A minimum of 300 feet of spray hose is required and additional hose may be necessary. Applicable Directives. The Contractor shall apply the herbicides to all locations as specified above and shall be held responsible for any off-site damage caused from spraying operations, such as over spraying, leaching, and public safety. The Contractor is prohibited from using Government property to clean equipment or dispose of any waste. Safety. The Contractor shall comply with all applicable Federal, State, and Local safety regulations, including US Army Corps of Engineers Occupational Safety and Health Requirements Manual, EM 385-1-1. For public use areas being treated, the Contractor is required to post removable signs stating “Herbicide Application in Progress” or something comparable while spraying operations are ongoing. This notice is to protect the general public and pets from unwanted and unknown exposure. The signs shall remain posted for 24 hours after any chemicals are applied. Security. The Contractor will be required to spray in areas that are both restricted and open to public access. For restricted areas, a Government representative will escort and give access to the Contractor to perform the work. A visitor log is maintained at each dam project office and will require the Contractor to sign in and out each day. The Contractor will not require a Common Access Card to perform this work. Mixing Location. The Contractor shall coordinate the location of a designated area for mixing and preparing herbicides with proper personnel. Emergency Action Plan. The Contractor is required to have a spill containment system constructed of impervious materials or an alternate as required. The Contractor is advised to dial 911 if any threats to the environment or public safety occur, notify dam personnel immediately and take appropriate action. Information on decontamination or emergency and non-emergency type spills may be obtained by contacting CHEMTREC toll free at 1-800-424-9300. Limited Access. The majority of areas to be treated are accessible by a high-volume spray rig with the exception of an 800 feet span in Beltzville’s emergency spillway. This will require hand spraying (backpack) or use of an ATV/UTV. Also, depending on weather conditions, the 9-acre Bear Creek Flood Plain at F.E. Walter Dam may be difficult to access. Other arraignments may be needed. (Again, it is highly recommended Contractors visit all sites prior to bidding.) 5.0 Measure and Payment Herbicide Treatment will be paid for at the contract unit price per gallon in accordance with treatment specifications, upon satisfied completion by the Authorized Representative of the Contracting Officer. If areas are missed and satisfied completion is not warranted after the Contractor leaves the project site after initial inspection, the Contractor will be required to return at no additional cost to the Government to ensure a satisfactory end product is achieved. Payment will be based on a spray rate of 100 gallons per acre solution. THE CONTRACTOR CANNOT ELECT TO SPRAY A MORE DILUTED SOLUTION THAN SPECIFIED ABOVE. Such payment shall be compensation for all labor, materials, equipment and incidentals necessary to perform the work. Award shall be made based on the lowest price and technically acceptable. The anticipated period of performance for delivery shall be from 01 June 2021 through 15 July 2021.
