FAR Part 6 Justification and Approval for Other than Full and Open Competition 1. Contracting Activity: US Army Engineer District, Philadelphia District, Corps of Engineers, 100 Penn Square East, Philadelphia, PA 19107-3391 2. Description of Action: This justification and approval (J&A) is being prepared for the use of a sole source award to the Contractor on Contract No. W912BU20C0033 using O&M funding, repair permeable paving blocks, in the firm fixed price construction contract for Armed Forces Medical Examiner System (AFMES) Warehouse Addition/Alteration project at Dover Air Force Base (DAFB), Dover, Delaware. The government will not purchase the permeable paving blocks directly but will be adding additional area of paving blocks by Modification to the existing firm fixed price (FFP) construction contract that is currently underway. The Modification is planned to be awarded using FY21 O&M funding. 3. Description of the Supplies/Service: The permeable paving blocks will replace existing failing areas outside of the contract limits where the new permeable paving blocks are being installed for truck delivery access to the existing AFMES Building. The estimated total cost for installation of the additional permeable paving blocks in the failed areas is approximately $51,400. 4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(b)(3), Only one responsible source and no other supplies or services will satisfy agency requirements in the timeline needed for delivery of the new addition to the AFMES Building. 5. Reason for Authority Cited: The existing permeable paving block access road used by delivery trucks for the existing nitrogen tanks at the AFMES Building has failed and needs to be replaced. The current project (i.e., Contract No. W912BU20C0033) is rerouting a portion and adding new permeable paving blocks that tie into existing failed permeable paving blocks to allow for nitrogen truck delivery around the AFMES Building Addition. The current condition is where the existing paving blocks are in such a poor condition, that tying the new blocks into the existing isn’t feasible and the Contractor has stated they won’t be able to warranty portions of the new permeable paving block installation. Due to the limited working space and scheduling with the existing work under Contract No. W912BU20C0033, it is not feasible for DAFB to hire another contractor to repair the failed paving blocks using FY21 O&M funding in the available timeline. Having the Contractor perform the repairs of the existing paving blocks is the only option that will allow for all of the new paving work to be warrantied. If procuring this work under the existing Contract is not pursued, the Government will either need to accept work that cannot be warrantied or descope the installation of the new permeable paving blocks (which then makes Contract No. W912BU20C0033 not a complete and usable project upon completion, since the nitrogen delivery is mission essential for AFMES operations). 6.
