THIS IS A SOURCES SOUGHT AND IS FOR INFORMATIONAL/MARKET RESEARCH PURPOSES ONLY. This is not a request for proposal, quotation or bid, nor a synopsis of a proposed contract action under FAR Subpart 5.2. This Sources Sought is to gain knowledge of the interest, capabilities, and qualifications of industry so the government can make informed business decisions. We are seeking responses from both large and small business members of industry to include: Small Business, Small Disadvantaged Businesses to include 8(a) firms, Historically Underutilized Business Zones (HUBZone), Woman-Owned Small Business (WOSB) to include Economically Disadvantaged Women-Owned Small Business (EDWOSB), Service-Disabled Veteran-Owned Small business (SDVOSB) and Veteran Owned Small Business (VOSB). All interested parties are highly encouraged to respond. The North American Industrial Classification Code (NAICS) for this requirement is: 541614 - Process, Physical Distribution, and Logistics Consulting Services and NAICS Code 541990 “All Other Professional, Scientific, and Technical Services”. 2. Project Background. The U.S. Army Corps of Engineers (USACE) Portland District (NWP) has the great privilege of working with the Department of Veterans Affairs (VA) to build medical facilities that serve our Veterans throughout the state of Oregon and Washington. Typical projects encompass the design and construction of the following: Service Buildings, Outpatient Facilities, Inpatient Hospital’s, seismic retrofits, utility improvements, parking structures, parking lots, asbestos and Hazardous material remediation, facility studies, and supporting work. Construction Management Services (CMS) will play a vital role in supporting delivery of vital facilities to support the Veterans of Oregon and Washington. The scope of this CMS contract will be specifically to support the design-build construction of buildings 110 and 111 at the Portland VA Medical Center. Project Scope. Portland District is seeking a Contractor that can provide CMS in the following areas: Quality Assurance, Scheduling, and Industrial Hygiene on their Veterans Affairs mega construction to monitor contractor progress and document compliance with the plans, specifications, and ancillary documents. The work to be performed will support US Army Corps of Engineers (USACE) Construction Branch missions, primarily within the boundaries of the Portland District (NWP) for Veterans Affairs Construction. CMS will be awarded through task-order-specific performance work statements (PWS), solicited on an as-needed basis. This is a non-Brooks act, non-personal services contract to provide professional, administrative, and quality services for CMS at the Portland VA Medical Center. The Government shall not exercise any supervision or control over the Contractor employees performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government. Work to be performed does not fall under the Brooks Act. Under this contract, the Contractor is prohibited from performing architect-engineer type services that require professional registration or design-related services, which require supervision by a registered professional. The Contractor is prohibited from performing survey or mapping services associated with architect-engineer type planning, development construction, design, or alteration of real property. The anticipated Firm Fixed Price (FFP) Multiple Award Task Order Contract (MATOC) will be for a single 5-year base period. The Period of Performance is anticipated to run August 2024 through August 2029. See attached Performance Work Statement for the complete requirement. a. Anticipated MATOC Capacity: $7,500,000 with up to three MATOC awardees. b. Anticipated MATOC Schedule: Award is intended for an ordering period of five (5) years. c. Estimated Construction Cost (ECC) of the D-B construction contract at the Portland VA Medical Center is over $500,000,000. Ref. DFARS 236.204 Disclosure of Magnitude. d. Interested parties’ responses to this Sources Sought shall be limited to five (5) pages and shall include the following information: a. Firm's name, address, point of contact, phone number, e-mail address, CAGE and UEI number. b. Firm's business category and size: Small Business, Small Disadvantaged Businesses to include 8(a) firms, Historically Underutilized Business Zones (HUBZone), Woman-Owned Small Business (WOSB) to include Economically Disadvantaged Women-Owned Small Business (EDWOSB), Service-Disabled Veteran-Owned Small business (SDVOSB) and Veteran Owned Small Business (VOSB). c. Provide a brief explanation of the prime firm’s capabilities and functions to be self-performed as it pertains to the proposed work outlined in the Project Scope. d. Project Examples: Provide a maximum of two (2) CMS project examples, similar in size, scope and complexity to the work described in paragraph 3 of this notice, with a brief project description, customer name, timeliness of performance, contract number, customer satisfaction, and the final project dollar value. OR To the extent a firm does not have the ability to perform the entire scope of the Project as outlined in the Project Scope, include up to two (2) relevant CMS project examples demonstrating those portions of the requirement in which your firm is capable of fulfilling. Include a brief description of each project, customer name, timeliness of performance, contract number, customer satisfaction, and the final project dollar value. The Government may verify information in CPARS or PPIRS. 4. Disclaimer and Important Notes. a. This notice does not obligate the Gov’t to award a contract. No reimbursement will be made for any costs associated with providing information in response to this Sources Sought or any follow up information. The Gov’t reserves the right to use information provided by respondents for any purpose deemed necessary and legally appropriate. Any organization responding to this notice should ensure that its response is complete and sufficiently detailed to allow the Gov’t to determine the organization's capabilities to perform the work. Respondents are advised that the Gov’t is under no obligation to acknowledge receipt of the information received or to provide feedback to respondents with respect to any information submitted. After a review of the responses a formal synopsis, requesting SF 330s may be published on Federal Business Opportunities. However, responses to this notice will not be considered adequate responses to a formal synopsis. b. All interested firms must be registered in the System for Award Management (SAM) at https://www.sam.gov and remain current for the duration of the source selection process to be eligible for award of a Gov’t contract. 5. Organizational Conflict of Interest: In accordance with FAR Subpart 9.5, Organizational and Consultant Conflicts of Interest (OCI), the Contracting Officer has determined that a significant potential for an OCI exists for the awardee resulting from the future solicitation posted in relation to this sources sought and the VA construction contracts managed by NWP at Portland, OR. Contained within this construction contract are requirements for the designer of record and/or construction contractor to perform work and submit deliverables to the Government. The contractors awarded this CMS MATOC will be required to review and validate work performed under the design-build construction contract at the Portland VA Medical Center which presents an impaired objectivity organizational conflict of interest. IAW 36.209 Construction contracts with architect-engineer firms: No contract for the construction of a project shall be awarded to the firm that designed the project or its subsidiaries or affiliates, except with the approval of the head of the agency or authorized representative.
