The U.S. Army Corps of Engineers (USACE), Portland District (NWP) intends to negotiate/award a sole-source contract with the Oregon Department of Environmental Quality (ODEQ), a State of Oregon agency, for a fee to apply for Clean Water Act Section 401 Water Quality Certification which will enable USACE to perform routine maintenance dredging and dredged material placement at the Columbia River in-water dredged material transfer sites in accordance with federal and state regulations. USACE will apply for Clean Water Act Section 401 Water Quality Certification and pay a fee in the total amount of $12,105.00 to ODEQ for certification approval. ODEQ will process the application and issue the certification in according with the state regulations. REASON FOR SOLE SOURCE ACQUISITION: ODEQ is the only one state agency that has authority to regulate, maintain, and protect the state natural resources hence ODEQ is the only state agency that can issue the Clean Water Act Section 401 Water Quality Certification. USACE must obtain a valid certification from ODEQ in order to perform routine maintenance dredging and dredged material placement at the Columbia River in-water dredged material transfer sites in the State of Oregon. There is no exception to this requirement. The statutory authority for this non-competitive acquisition is in accordance with 41 U.S.C.1901 as implemented by FAR Subpart 13.5 - Simplified Procedures for Certain Commercial Products and Commercial Services.
