This is a SOURCES SOUGHT notice to address the potential use of Project Labor Agreements (PLA) for a large scale construction project within the Milton, WV area by the U.S. Army Corps of Engineers (USACE) Huntington District. This notice does not constitute a solicitation announcement, nor does it restrict the Government to an ultimate acquisition approach. No solicitation or technical scope of services is available at this time. The Government will use the responses to this SOURCES SOUGHT notice to make acquisition decisions. Milton, WV has a history of flooding dating back to the early 1900s. With several large record flood events creating public safety issues and economic damage over the years. The Milton, WV Flood Risk Management Project aims to provide flood risk reduction and management to the residences and businesses of Milton, West Virginia. The project is designed to significantly reduce flood risk to most of the City of Milton by constructing a levee to provide benefits to over 600 structures including residences and businesses, along with protection of public structures, personal property, and critical infrastructure. The project will require heavy construction which will primarily consist of earthwork, underground seepage barrier, cast-in-place concrete, buildings, utilities, slope protection, and environmental mitigation. Construction will generally consist of: earthwork necessary to build an earthen levee approximately 8,300 linear feet in length, two pump stations capable of pumping approximately 60,000 – 90,000 gallons per minute, a gate closure necessary to maintain vehicular access through the levee, a sub-surface seepage barrier with depths ranging from 25 to 65 feet, relocation of approximately 4,300 linear feet of the existing Mud River, construction of environmental habitat mitigation areas, demolition of existing structures, and land development needed to provide access roads and utilities needed to operate and maintain the project after construction. A PLA is defined as a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U.S.C 158(f). Federal Acquisition Regulation (FAR) Policy: (a) Project Labor Agreement (PLA) is a tool that agencies may use to promote economy and efficiency in Federal procurement. Pursuant to Executive Order 13502, agencies are encouraged to consider requiring the use of project labor agreements in connection with large-scale construction projects. (b) An agency may, if appropriate, require that every contractor and subcontractor engaged in construction on the project agree, for that project, to negotiate or become a party to a project labor agreement with one or more labor organizations if the agency decides that the use of project labor agreements will (1) Advance the Federal Government's interest in achieving economy and efficiency in Federal procurement, producing labor-management stability, and ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other matters; and (2) Be consistent with law. Reference: Provision: 52.222-33 Notice of Requirement for Project Labor Agreement Clause 52.222-34 Project Labor Agreement. Request responses to the following questions: 1. Do you have knowledge that a PLA has been used in the local area on projects of this kind? If so, please provide supporting documentation. 2. Are you aware of skilled labor shortages in the area for those crafts that will be needed to complete the referenced project? If so, please elaborate and provide supporting documentation where possible. 3. Are you aware of time sensitive issues/scheduling requirements that would affect the rate at which the referenced project should be completed? If so, please elaborate and provide supporting documentation where possible. 4. Identify specific reasons why or how you believe a PLA would advance the Federal Government's interest in achieving economy and efficiency in federal procurement. 5. Identify specific reasons why you do not believe a PLA would advance the Federal Government's interest in achieving economy and efficiency in federal procurement. 6. Identify any additional information you believe should be considered on the use of a PLA on the referenced project. 7. Identify any additional information you believe should be considered on the non-use of a PLA on the referenced project. 8. Have you ever used a PLA for a construction project? If so, what was the project (dates & location)? Will a PLA impact the cost of submitting an offer? 9. Will the use of a PLA produce management-labor stability on this project? 10. Are you aware of examples of labor-management conflicts in the area which could affect the efficiency of this project, which a PLA could positively impact/resolve? 11. Will use of PLA be conducive to ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards and other relevant matters? 12. The project will require multiple construction contractors and/or subcontractors employing workers in multiple crafts or trades. How are you going to fulfill your labor needs? 13. Will the use of PLA impact the ability of potential offerors and/or subcontractors to meet small business utilization goals? This is NOT a Request for Proposal and does not constitute any commitment by the Government. Responses to this labor market survey will be used by the Government to make appropriate acquisition decisions. All interested sources must respond to future solicitation announcements separately from responses to this survey.
