The Medical Readiness Contracting Office - Pacific, in support of MEDCOM, intends to make a sole source award to Cepheid for a firm fixed-price contract for repair part modules for the GeneXpert GX Diagnostic Testing Analyzers for Camp Humphrey, Korea. The NAICS code of this procurement is 325413. The statutory authority permitting this award without providing full and open competition is FAR 13.106-1(b)(1) which authorizes the government to award contracts when there is only one responsible source and no other suppliers or services will satisfy agency requirements. This announcement fulfills the synopsis requirements under FAR 5.201 and 5.203. This Notice of Intent is not a request for competitive quotes; however, all responsible sources may submit a capability statement or quotation which shall be considered by the agency. However, the Republic of Korea (ROK)-United States (U.S.) Status of Forces Agreement (SOFA), may preclude the U.S. Government from granting Invited Contractor or Technical Representative Status to any quoters, for this requirement. All sources submitting a quote, including U.S. sources, must already have OR confirm their ability to obtain the requisite business licenses directly from the ROK Government, and conduct business in accordance with all applicable ROK laws, including but not limited to, rules and policies regarding labor, taxation, and immigration. If an initial quote does not fully demonstrate this authorization and capacity, it will not be further considered for award. Whether a quoter demonstrates this authorization and capacity shall be determined by the Contracting Officer.
