This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice, such as Statement of Work (SOW), Attachment 0001, dated 22 July 2020, Attachment 0002, Document Summary List (DSL), Attachment 0003, Parts List, and enclosed addenda with additional clauses . This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. (ii) The solicitation number is W58RGZ-20-Q-0045 is issued as a request for quotation (RFQ). (iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020-04. (iv) This is a 100% Historically Underutilized Business (HUBZone) Set-Aside in accordance with FAR 19.1305. The associated NAICS code is 336413 with a business size of 1250 employees. (v) The spare parts being solicited are included under attachment 0003, entitled Parts List for Uruguay Bell 212 Aircraft Spare parts dated 22 July 2020. The Contractor shall include in the Bell 212 spare parts cost all fees, spare part cost, shipping to consolidation location and destination and storage until shipment to destination. The Contractor is responsible for import/export license and shall be compliant with applicable policy, regulatory, statutory and international requirements. The USG will coordinate Value Added Tax (Tax) exemption. (vi) The procurement and shipment of Bell 212 Aircraft spare parts in support of the United States (U.S) Security Cooperation Office – Uruguay and the U.S. Southern Command (USSOUTH) Global Peace Operations Initiative (GPOI). (vii) The Contractor shall consolidate components for inspection and shipment at its facility no later than (NLT) 120 days after contract award and deliver to the address below NLT 180 days from contract award. (ix) Basis for Award: 52.212-2 Evaluation Commercial Items (Oct 2014) (a) The Government will make an award based on the Lowest Price Technically Acceptable (LPTA) proposal, as set forth below and in accordance with FAR Subpart 12 and Subpart 13.5, as supplemented by DFARS Subpart 213. The Government intent is to award a single contract. The Government anticipates awarding to the responsible offeror, whose quotation is determined technically acceptable, meets the delivery schedule set forth in this solicitation and offers the lowest price; 1) Minimum Requirements to determine acceptability: The proposed parts must fall under one of the following categories: new, new surplus or overhauled; The proposal shall adhere to the inspection and delivery schedule set forth in the Statement of Work; and The proposal shall reflect a confirmation of commercial warranty for the proposed parts and shall begin at acceptance in Uruguay. 2) Past Performance: The Government will evaluate each offeror past performance history in the Supplier Performance Risk System (SPRS) for PSC 1680 IAW DFARS clause 252-213-7000. 3) Price Evaluation. The Government will fully evaluate the proposed FFP Contract price. The Government will evaluate offers for fairness, reasonableness, and compliance; 4) Solicitation Requirements (Terms and Conditions). Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and Statement of Work (SOW) requirements, in addition to those identified under this section. Failure to comply with the terms and conditions of the solicitation may result in the offeror being ineligible for award. Offerors must clearly identify any exception to the solicitation term and conditions and must provide complete supporting rationale. The Government reserves the right to determine any such exceptions unacceptable, and the proposal, therefore, ineligible for award. (b) Options: No Options are included with this requirement (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Offerors shall consult the System for Award Management (SAM) to validate whether the equipment or services they are offering are from an entity that uses equipment or services listed in the definition of “covered telecommunications equipment or services”, including any known subsidiaries or affiliates. If a vendor selects “does” to either of the representations under 52.204-26, it is required to represent, offer-by-offer, that they “will” or “will not” provide that equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from the solicitation and that it “does” or “does not” use any covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment, system, or services. (xi) 52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (Dec 2019) The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services-Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items. (a) Definitions. As used in this provision— “Covered telecommunications equipment or services”, “critical technology”, and “substantial or essential component” have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment. (b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing— (1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or (2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
