The U.S. Army Contracting Command-Warren intends to award a three-year Firm Fixed Price requirements contract under solicitation W56HZV-19-R-0127 for T-9 Medium Dozer vehicles equipped with Electric over Hydraulic (EoH) technology inserts meeting the specifications in Army Automotive Tank Purchase Description 2371; Related Hardware to include uninstalled armor Crew Protection Kits and Special Tools and Test Equipment; and Ancillary Services to include Instructor & Key Personnel Training and Field Service Representative support for vehicle maintenance, logistics, and testing. This contract will establish two 12-month ordering periods with an additional one 12-month ordering period as an option for a total potential contract length of three years. The estimated quantities of each hardware item to be procured are 51 each T-9 Medium Dozer Type I, two each T-9 Medium Dozer Type II, 33 each Crew Protection Kits, and eight each Special Tools and Test Equipment. This action will be awarded on a sole source basis to Caterpillar, Inc. of Peoria, IL. The proposed contract action is for vehicles, hardware, and services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1 “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” Specifically, FAR 6.302-1(a)(2)(ii)(A) and (iii)(A), states, “Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major component thereof, when it is likely that award to any other source would result in – (A) substantial duplication of cost to the Government that is not expected to be recovered through competition” and “For DoD, NASA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result - (A) substantial duplication of cost to the Government that is not expected to be recovered through competition”. Caterpillar Inc. is the only company able to supply the Army’s need for production and delivery of T-9 Medium Dozer vehicles equipped with EoH technology inserts, related hardware, and ancillary services without causing a duplication of cost to the Government. This is a notice of intent, not a request for competitive proposals, or a solicitation of offers. However, all responsible sources may submit a capability statement, bid, proposal, or quotation, which shall be considered by the agency. A determination not to compete this proposed contract action, upon response to this notice, is solely within the discretion of the Government.
