The U.S. Army Contracting Command – Detroit Arsenal intends to award a three-year, Firm Fixed Price contract modification to extend the existing requirements contract W56HZV-15-D-0052 to procure Field Service Representative support services supporting Interim Contractor Logistics Support (ICLS), refurbishment services, special tool kits, and spare parts for Crane Training Simulators, all for the Type II Heavy Crane (T2HC). This contract extension will establish three 12-Month ordering periods. This action will be awarded on a sole source basis to Grove U.S., L.L.C. of Shady Grove, PA. The proposed contract action is for hardware and services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1 “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. Specifically, FAR 6.302-1(a)(2)(ii)(B) and (iii)(B), states, “Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major component thereof, when it is likely that award to any other source would result in – (B) unacceptable delays in fulfilling the agency’s requirements” and “For DoD, NASA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in - (B) unacceptable delays in fulfilling the agency’s requirements.” Grove U.S., L.L.C. is the only company able to supply the Army’s need for ICLS, refurbishment services, special tool kits, and spare parts for the Crane Training Simulators without causing an unacceptable delay to the Government. This is a notice of intent, not a request for competitive proposals, or a solicitation of offers. However, all responsible sources may submit a capability statement, bid, proposal, or quotation, which shall be considered by the agency. A determination not to compete this proposed contract action, upon response to this notice, is solely within the discretion of the Government.
